Based on our review of the applicable statutes and <br />rules, we provide the following information. <br /> <br />I\1innesotu Statutes Chapter 19B broadly regulates the distribution, use, storage, <br />handling, and disposal of pesticides. In addition, the Commissioner of Agriculture is charged <br />with administering, implementing and enforcing the regulation of pesticides. See Minn. Stat. 9 <br />18B.03. The Chapter expressly preempts ordinances by local governments that regulate any <br />matter relating to the registration, labeling, distribution, sale, handling, use, application, or <br />disposal of pesticides, unless the local government is specifically granted the authority within <br />the Chapter. Minn. Stat. 9 18B.02. As a result, the City is precluded from regulating <br />pesticides in all areas except those in which the legislature has expressly granted local <br />governments such authority. <br /> <br />The City has been granted the authority to enact an ordinance containing specific <br />pesticide application warning information, as well as licensing, penalty and enforcement <br />provisions related to such warning signs. Minn. Stat. 9 18B.09, subd. 2. However, the City <br />
