Variance Board Meeting <br />Minutes – Wednesday, July 12, 2006 <br />Page 6 <br />Joe Pearson, 759 Lakeview Avenue, St. Paul, MN 55117 <br />Mr. Pearson questioned whether the City allowed other options, such as a dry well. <br />City Engineer Bloom responded affirmatively, noting that was her intent in making the <br />condition more general, to allow flexibility on a case by case basis. <br />With no one else appearing for or against, Acting Chair Boerigter closed the Public <br />Hearing. <br />Acting Chair Boerigter opined that he was not comfortable with applying conditions <br />requiring significant changes or installation of a rain garden, outside existing policy <br />provisions, with little notice to the applicant regarding mitigations conditions. Chair <br />Boerigter spoke of a preference for the Board to look at such a policy from an overall <br />city-wide standpoint. <br />Further discussion included Commissioners seeking consistency in limiting runoff <br />and drainage mitigation; types of mitigation (i.e., gutters; rain garden; other <br />retention); and options available to the property owner as assisted by staff. <br />Commissioner Roe suggested compromise language to ensure staff’s intent and <br />allow flexibility for each site, but conditioning the requests that “no net increase” <br />would be seen on a particular site. <br />City Engineer Bloom concurred with such language. <br />Motion: <br />Member Doherty moved, seconded by Member Roe, to adopt a resolution <br />approving a 1 foot variance to City Code, Section 1004.016 (Required Side Yard <br />Setback) and a 505 square foot variance to City Code, Section 1004.016 <br />(Maximum Total Surface Area) to allow construction up to 864 <br /> sf of a 768 <br />square foot detached accessory structure and additional driveway in the rear <br />yard of 2612 Wheeler Street, based on the comments and findings of Section 5 <br />and the conditions of Section 6 of the project report dated July 12, 2006; as <br />amended to allow the proposed structure up to two feet (2’) from the side lot <br />line; and the addition of a new condition (g) reading:” Mitigation methods must <br />be undertaken to divert water and rate of runoff from the site as approved by <br />the City Engineer.” <br />Ayes: 3 <br />Nays: 0 <br />Motion carried. <br />Acting Chair Boerigter advised the applicant of the appeal process timeframe. <br /> d. PLANNING FILE 3773 <br /> VARIANCE to Section <br />Request by Ann Severson, 617 S Owasso Boulevard, for a <br />1004 (Maximum Total Surface Area and Minimum Parking Setback) and Section <br />703.04B (Driveway and Parking Lot Standards) <br />to allow the expansion of the <br />existing driveway to a width of 27.5 feet at the front property line and to a distance of <br />3.5 feet from the side property line. <br />Acting Chair Boerigter opened the Public Hearing. <br />Associate Planer Lloyd reviewed the request of Ann Severson (i.e., the Ann <br />Severson Living Trust) for a variance to City Code, Section 703.04B (Driveway <br /> <br />
