<br />WHEREAS, the Village Council deems it necessary <br />and expedient and in the best interest of the Village <br />and its inhabitants that the Village acquire permanent <br />easement across and under certain land for the above <br />purposes; and <br /> <br />WHEREAS, the statutes of the State of Minnesota <br />state that the Village has the power and authority <br />to take and acquire said property by condemnation <br />under the power of eminent domain; <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE VILLAGE <br />COUNCIL FOR THE VILLAGE OF ROSEVILLE, MINNESOTAg <br />AS FOLLOWS: <br /> <br />The Village Council hereby deems it necessary <br />and expedient that the Village acquire a permanent <br />easement across the property described as follows: <br /> <br />A perpetual easement for the purpose of <br />operation and maintenance of a storm sewer <br />approximately 4 to 8 feet deep across the <br />following described property: <br /> <br />The Northeast One-Fourth (NW \) of the <br />Southeast One-Fourth (SE \) of Section 10, <br />Township 29, Range 23, except the East <br />264 feet thereof and the East one-half <br />(E ~) of the Northwest One-Fourth (NW ~) <br />of the Southeast One-Fourth (SE \) of <br />said Section ~O, all except parts taken <br />for roads and highways. <br /> <br />Which easement is described as follows: <br />All that part of the above described <br />property lying 7.5 feet on either side <br />of the following described line: <br /> <br />Commencing at the Northeast corner of <br />the Southeast One-Fourth (SE ~) of said <br />Section 10i thence Westerly along the <br />North line of said Southeast One-Fourth <br />(BE \), said line being assigned a bearing <br />of North 900 00' West, a distance of 1317 feet <br />
