<br />In order to determine NSP's compliance with this condition, a survey <br />of existing radio broadcast and television broadcast signals within 300 <br />feet either side of the route of the 345 kv transmission line shall be <br />made by a disinterested arbitrator whose decision shall be finaL The <br />arbitrator shall be chosen by the Village, but must be a consulting <br />engineer with recognized competency in the field, agreeable to NSP, <br />and must be selected not later than September 10, 1967. Should the <br />Village fail to name an arbitrator agreeable to NSP before that date, <br />NSP may submit to the Village in writing the name of such arbitrator plus <br />an alternate. Within five days from the receipt of such notice, the <br />arbitrator so named by NSP shall be the arbitrator selected by the <br />parties, unless the Village, within said five-day period, notifies <br />NSP in writing that it has selected the alternate, in which case such <br />alternate shall be the arbitrator selected by the parties. Thereafter, <br />the arbitrator shall personally inspect and determine in a manner <br />satisfactory to him, the present quality of radio broadcast and <br />television broadcast signal reception in the buildings within the <br />area covered by this paragraph. This inspection shall be completed <br />before the line is constructed. A representative of the Village and of <br />NSP may accompany the arbitrator on such inspection. If, after <br />reasonable efforts, the arbitrator is unable to obtain access to any <br />building for inspection, his inspection of such buildings shall be <br />deemed complete. After completion of the line, the arbitrator shall <br />again inspect and determine, in a manner acceptable to him, the then <br />existing quality of radio and television broadcast reception in the <br />area covered by this paragraph, and shall notify NSP of those radio <br />or television receivers where, in his opinion, remedial action is <br />necessary. After remedial action is taken by NSP, the arbitrator's <br />certificate that NSP has complied with its obligations under this <br />paragraph shall be final and conclusive on the parties. The reasonable <br />fee of the arbitrator shall be paid by NSP. <br /> <br />7. Not later than June l, 1968, NSP shall submit to <br />the Village Council a plan for decorative plantings at NSP' s expense <br />of small trees and shrubs immediately adjacent to the poles or towers <br />on NSP easements or street right of way, in the area marked in red on <br />the attached drawing, marked Exhibit 1. As provided in Paragraph <br />l2.045 of the Village Code, a bond in the amount of one and one-half <br />times the engineer's estimate of the cost of the planting and screening <br />shall be filed by NSP with a condition in said bond requiring that the <br />screening to be planted or constructed shall be maintained for two years <br />by NSP. After two years, the maintenance of said plantings shall be <br />the responsibility of the landowner or governmental agency or unit <br />involved.
