Regular City Council Meeting <br />Monday, June 18, 2007 <br />Page 34 <br />Further discussion ensued regarding potential continuation until the <br />July meeting to allow the applicant additional time to submit the re- <br />quested information before the City Council took action; staff clarifi- <br />cation that the August 3, 2007 date was when the review period <br />ended, and time needed by staff to complete their analysis and prepare <br />recommendations and packet materials (two weeks before Council <br />meeting action on July 16`h or July 23, 2007); appropriateness of de- <br />sign issues in the land use approval controls and staff s correlation of <br />design elements in the PUD process from the concept stage to final <br />plat stage; environmental review considerations; and staff's clarifica- <br />tion that the detailed scope for the traffic study had been provided to <br />the applicant well over a month ago. <br />Councilmember Pust reiterated her request that the applicant make a <br />determination on which option they wanted to pursue tonight: for the <br />application to voluntarily extend the application; or for the Council to <br />vote to approve or deny. <br />Mr. Livingston advised, in light of his time constraints with the pur- <br />chase agreement with the seller, he was forced to ask the City Council <br />to take a vote tonight on the project and application as presented. <br />Robert Hajek, Xtra Lease, representing owner of the trucking <br />site, (office address: 3433 Broadway Street NE, Suite 110, Min- <br />neapolis, MN 55413) <br />Mr. Hajek provided a brief review of this site's history related to <br />threats of condemnation and ultimate and unprecedented withdrawal <br />of condemnation proceedings by the City; the moratorium imposed by <br />the City; Xtra Lease's desire, as a national and international company, <br />to be a good neighbor in Roseville; status of the Ramsey County Dis- <br />trict Court Order related to studies completed on the Twin Lakes area <br />properties; current dispute in court regarding surety bonds between <br />the City and Twin Lakes LLC; and other issues in attempting to pro- <br />ceed with this development. <br />Mr. Hajek advised that Xtra Lease had been patient and had held this <br />land for years as it awaited resolution to the above issues; however, he <br />advised that they will not continue to do so; and if necessary, would <br />return to storing trucks on the property through completion of a long- <br />
