City Council Study Sessio Monday, July 16, 2007 Page 22 Mayor Klausing noted the language of the Public Works, Environ- ment and Transportation Commission as required by statute; with staff clarifying the language wording related to a "negative declaration as to an EIS ." City Attorney Anderson provided additional clarification of State Statute procedures related to the RGU's ability to postpone their de- ter~nination for thirty (30) days if they feel there is insufficient infor- mation to make that determination; requesting that the proponent gather and bring forward identified and readily-obtainable informa- tion. Mr. Anderson further clarified, and Mayor Klausing confirmed, that if the information was not deemed readily obtainable, and it was determined that they were needed to address whether there were sig- nificant environmental impacts needing further study, that would be a positive declaration for the need for an EIS, if those items in all prob- ability will not be mitigated or properly identi~ ed. Mr. Anderson concluded that the EAW served as the scoping document to determine if an EIS was warranted. Mayor Klausing interrupted the meeting for a determination of which items were included in additional discussion prior to the extended meeting time. Those items were identified and approved by consensus, as Items S.g, S.h, and S.j, respectively entitled, "Discuss completion of the Updated AUAR or of a discretionary EAW prior to approval of the land use application for 2700 Cleveland Avenue;" "Presen- tation of the Revised Draft Twin Lakes AUAR;" and "Discussion on the Housing and Redevelopment Authority Appointment Process." g. Discussion -Discuss Completion of the Updated Alternative Ur- ban Areawide Review (AUAR) or of a Discretionary Environ- mental Assessment Worksheet (EAW) Prior to Approval of the Land Use Application for 2700 Cleveland Avenue Community Development Director John Stark reviewed staff's re- quest that approval of the land use application for 2700 Cleveland Avenue (Cent Ventures) be withheld until completion of the updated Twin Lakes Alternative Urban Areawide Review (AUAR) or until the applicant agrees to participate in the completion of a Discretionary EAW.
