NOW THEREFORE, BE IT RESOLVED BY THE VILIAGE COUNCIL FOR THE VILIAGE OF ROSEVILLE, MINNESOTA, AS FOLLOWS: The Village Council hereby deems it necessary and expedient that the Village acquire permanent easement across the property described as follows: Easement No. W-6626B A perpetual easement l5 feet wide over that part of the NE 1/ 4 of Section 5, Township 29, Range 23, lying between the Minnesota Transfer Railway Company R/W and State Highway I-35W except the following: Commencing at a point of the East line of said R. R. Company R/W, said point lying on the South line of said NE l/4 of Section 5; thence NW'ly along said R/W line 626.5 feet; thence SE'ly 268.7 feet to a point lying 445 feet North of and 1041. 0 feet East of the center of said Section 5; thence E'ly 83.26 feet; thence S'ly 445 feet to the South line of said NE 1/4; thence W'ly to point of beginning, all subject to roads and easements of re cord, The centerline of said easement being described as follows: Commencing at a point on the East line of the Minnesota Transfer R. R. Co., R/W in the SW 1/4 of the NE 1/4 of Section 5, Township 29, Range 23, said point lying 7 1/2 feet NE 'l y of and measured perpendicular to the following described line: Commencing at a point lying 33 feet South of and 635.5 feet East of the NW corner of said Section 5, thence SE'ly to a point lying 445 feet North of and l04l feet East of the Coo ter of said Section 5 and there tenninating; thence SElly parallel with and 7 1/2 feet NElly of the last described line, a distance of approximately 186 feet to a pOint lying 7 1/2 feet SE'ly of and measured perpendicular to the SW line of the 50 feet N.S. P. Co. R/W as it now exists; thence NElly, parallel to and 7 1/2 feet distant from said SE line of said N. S. P. Co. R/W approximately 950 feet to the North line of the SE 1/4 of the NE 1/4 of said Section 5; thence E'ly along said North line approximately 100 feet to the West R/W line of I.H. 35-Was it now exists and there terminating, to a depth of 8 feet. That permanent easements be acquired for the purposes of construct- ing, maintaining and operating underground water mains, pipes and appur- tenances for the Village of Roseville Minnesota, together with ingress and egress.
