regular City C®uncil eating 1VI®nday, July 23, 2007 Page 32 a® nvir®n a tal Assess e t ®r eat ( A - C®nsi er - r®ving an ®r ®rt western ®lee City Planner Thomas Paschke introduced the Northwestern College presentation of their discretionary Environmental Assessment Work- sheet (EAW) related to their Master Plan and request for an Amended Planned Unit Development (P~JD). Agenda packet materials included the EAW; comments from agencies; comments from residents and resident associations and college responses to all comments; as well as a draft resolution provided by staff for Council consideration and enti- tled, "Resolution Establishing Findings of Face, Conclusions of Law and ®rder Issuing a Negative Declaration for an Environmental Im- pact Statement (EIS) on the Development Known as the Northwestern College Master Plan. Mayor Klausing sought Council questions for staff prior to hearing public comment. Councilmember Ihlan asked how tonight's public comment would be incorporated into potential Council action; and who drafted the find- ings of face, and their apparent conclusion that there was no basis for an EIS, with no optional resolution for the Council declaring that there was need for an EIS. City Attorney Anderson advised that the draft resolution was drafted by the City Attorney office, with input from staff, to ensure that the proposed findings complied with requirements under Minnesota State Statute and environmental rulings and acts. Mr. Anderson advised that, from the City Attorney's perspective and based on staffs evi- dence, and their skill and experience, they were proposing a negative declaration, and had asked for his office's assistance in drafting the document. Councilmember Ihlan again stated that the City Council had no docu- ments for any alternative course of action. Mayor Klausing duly noted Councilmember Ihlan's to various agency and public comments to-date; and if the EAW was the same draft pro- vided to the City Council at their last meeting.
