regular City C®uncil eating <br />1VI®nday, July 23, 2007 <br />Page 32 <br />a® nvir®n a tal Assess e t ®r eat ( A - C®nsi er - <br />r®ving an ®r ®rt western ®lee <br />City Planner Thomas Paschke introduced the Northwestern College <br />presentation of their discretionary Environmental Assessment Work- <br />sheet (EAW) related to their Master Plan and request for an Amended <br />Planned Unit Development (P~JD). Agenda packet materials included <br />the EAW; comments from agencies; comments from residents and <br />resident associations and college responses to all comments; as well as <br />a draft resolution provided by staff for Council consideration and enti- <br />tled, "Resolution Establishing Findings of Face, Conclusions of Law <br />and ®rder Issuing a Negative Declaration for an Environmental Im- <br />pact Statement (EIS) on the Development Known as the Northwestern <br />College Master Plan. <br />Mayor Klausing sought Council questions for staff prior to hearing <br />public comment. <br />Councilmember Ihlan asked how tonight's public comment would be <br />incorporated into potential Council action; and who drafted the find- <br />ings of face, and their apparent conclusion that there was no basis for <br />an EIS, with no optional resolution for the Council declaring that there <br />was need for an EIS. <br />City Attorney Anderson advised that the draft resolution was drafted <br />by the City Attorney office, with input from staff, to ensure that the <br />proposed findings complied with requirements under Minnesota State <br />Statute and environmental rulings and acts. Mr. Anderson advised <br />that, from the City Attorney's perspective and based on staffs evi- <br />dence, and their skill and experience, they were proposing a negative <br />declaration, and had asked for his office's assistance in drafting the <br />document. <br />Councilmember Ihlan again stated that the City Council had no docu- <br />ments for any alternative course of action. <br />Mayor Klausing duly noted Councilmember Ihlan's to various agency <br />and public comments to-date; and if the EAW was the same draft pro- <br />vided to the City Council at their last meeting. <br />
