egular City C®uncil eetin~ <br />1VI®nday, July 23, 2007 <br />Pale 5 <br />City Attorney Scott Anderson advised that he had received an n e- <br />mail and copy of the document from City Planner Thomas Paschke; <br />reviewed the duties of the EQB to accept petitions for EAW to deter- <br />mine their validity under the Environmental Protection Act; and rec- <br />ommended to the City Council that no action be taken on the proposal <br />tonight, even provisionally. Mr. Anderson advised that staff would <br />need to present to the City Council, under appropriate rules, the peti- <br />tion for EAW and seek a determination by the City Council, once the <br />EQI3 determines the validity of the petition. <br />Further discussion ensued regarding the process; Mr. Mueller's re- <br />quest for conditional approval, subject to appropriate environmental <br />review; and City Attorney Anderson's recommendation that no action <br />be taken at this time. <br />Pust moved, Ihlan seconded, striking Agenda Item 12.c entitled, <br />"Consider Approving Final Plat and Public Improvement Contract for <br />®ak Acres (Art Mueller) at 2201 Acorn Road;" from tonight's <br />agenda, due to pending environmental review. <br />®11 fall <br />Ayes: Pust; Roe; Ihlan; I~.ough; and Klausing. <br />Nays: None. <br />e. any Ne r°as, .1276 dri a .Avenue <br />1~/Ir. Neprash discussed the status of Little Lake Johanna on the im- <br />paired water list; Total Maximum Daily Loads (TNIDL) implementa- <br />tion studies for Little Lake Johanna; Metropolitan Council responses <br />regarding the Northwestern College land use case and environmental <br />review; and potential funding for such a study. <br />Mr. Neprash requested that the City Council ask the City's Public <br />Works, Environment, and Transportation (PV'VET) Commission to <br />look at this question and forward a recommendation to the City Coun- <br />cil as to whether the City Council should move jointly with the Rice <br />Creek Watershed District (RCWD) in seeking a TMDL Study. <br />
