tQ exempt it From further review. ~f not, the ~.~I~ would ha~re ~.e op~ron of dating the
AT.JAF~. to account far this project, or review this project separately in an EAi~T. The
updating of the A~[.TAIZ. w®uld also be a way to address the eve year requirement at the
same ti~a~ a~ ~~a~g~~g it to ~ac~eo~t far t~~ p~-o~es$.
It also appears that part of the issue that needs satisfactory resolution is the basis upon
which the decision to require an EAV~ is made by the city. The E(~13 rules do not dictate
the manner of that decision; that is a local matter. The form of the decision that the rules
prescribe is a retard of decision including finding of facts that lead to the conclusion of
ordering an EA'G~. An l~C~tT may exercise that authority through the operation of decision
made ~y a ~oarcl or council tcity council, planning can~niss~ioz~ or oth~j or delegate that
authority to single individual (mayor, city manager, planning director, or city
develapment coordinator). host cities retain that authority to the city council and the
c~€cis;a~ i~ f~-~~ue~t~y ~~pressed ~s .a resolaat~on or motion of the council.
used on tl~e limited. information in your letter, it seems probable that the ~.~13 d©es have
the discretionary authority to order environmental review of this project; and furthermore
at its discretion, decide if that review should be an EAST or be covered in the AUAR..
Although it appears that the city has cornrn.unicated to you that EA~I is necessary, it
isn't possible to say, from your letter, how that decTSYOn was rz~ade. ~Iat may he ate tssae
that you will need to clarify with the city. E~F3 rules do not specify how the decision is
made or who makes it; only the basis of the decision as found in the rules.
I hope this information is helpful. Please feel free to call or have any of the parties from
the city call with further questions. ~.y number is 65l -2~l -2477
"incerely,
~~~.-
3on Larsen, Principal Planner
