Minutes of 8/27/07 <br />Regular City Council Meeting <br />Page 11 <br />by the applicant, which had been clearly conditioned on the Prelimi- <br />nary Plat approval. <br />Public Works Director Duane Schwartz <br />1) Mr. Schwartz advised that the rights-of--way shown at fifty feet <br />(50') were allowed under City Code where there was somewhat of <br />a hardship, in this case an attempt to preserve trees and/or mitigate <br />wetland areas. <br />2) Mr. Schwartz advised that staff interpreted City Code to mean that <br />the eighty foot (80') cul-de-sac did meet City Code; noting that <br />any road less than two hundred feet (200') in length didn't require <br />a cul-de-sac at all, but opined that this was a good alternative, <br />rather than a simple turnaround. <br />3) Mr. Schwartz advised that soil borings had been provided to staff <br />for the biofiltration basins; and the City Engineer continued to <br />work with the applicant's engineer on the proposed systems, which <br />had yet to be finalized and approved by staff. Mr. Schwartz further <br />advised that staff was cognizant of MPCA regulations and best <br />management practices, and indicated that the soil types in the <br />biofiltration area were types B and C, and represented "engineered <br />soils" and would need to meet filtration requirements. <br />City Attorney Anderson fully agreed with Mr. Schwartz's comments <br />on the road layout and design, as previously addressed as an issue of <br />adjacent neighbors during Preliminary Plat approval. <br />Councilmember Roe clarified requested Council action on Final Plat <br />approval including approval of the public improvement contract and <br />whether the contract spoke to design of the biofiltration trenches or if <br />that was a City staff and City engineer determination as part of the <br />process addressed in the contract. <br />Mr. Schwartz advised that the public improvement contract spoke to <br />the biofiltration trenches but that their final design and location of <br />easements remained pending until engineering designs were negoti- <br />ated and completed in accordance .with City Code and approved by <br />the City Engineer. <br />
