Minutes of 8/27/07
Regular City Council Meeting
Page 30
ceived that the majority of the City understood that potential devel-
opment. Mr. Houck referenced the Comprehensive Plan and minutes
of City Council action from June 26, 2001, as he printed it out from
the City's website and opined that he didn't see anywhere that it refer-
enced more than one scenario. Mr. Houck expressed frustration that
he had not received a copy of Mr. Squires' legal opinion, even though
he had requested one. Mr. Houck opined that he found no evidence
that the AUAR was complete and accurate when it didn't comply with
the City's own Comprehensive Plan.
City Attorney responded to comments of Mr. Squires' legal opinion,
and clarified that opinion; addressing the fact that the Master Plan
document acted upon by the City Council by resolution at their June
26, 2001 meeting included reference to nine (9) maps, including the
one showing the different scenarios. Mr. Anderson further reviewed
actual language of court rulings and their specific ruling, along with
the Court. citing that while the Comprehensive Plan didn't recommend
big box retail, it didn't prohibit it.
Additional discussion ensued.
Ihlan moved, [Kough seconded,] addition of another scenario to the
AUAR Update that didn't include any large scale shopping centers or
big box retail uses.
Councilmember Kough questioned the procedure of including this
scenario.
Councilmember Pust concurred with Councilmember Kough's obser-
vations opining that a no-retail scenario should be part of a new Com-
prehensive Plan and not applicable for this AUAR Update. Council-
member Pust further opined that the purpose of the AUAR was to
provide a ceiling or worst case scenario for the area to allow a deter-
mination of all environmental degradations; and further opined that
the City already knew that such a scenario was less than the worse
thing, with less traffic, less environmental impacts, and requiring less
mitigation.
