master plan concept created by John Stark exists. If any written legal opinion exists, it
should be a part of this analysis.
CONCLUSION
The Twin Lakes Master Plan, as adopted June 26, 2001, and as evidenced by the
Master Plan attached to the June 26, 2001 minutes, and the Twin Lakes AUAR adopted
by Council by on the same date, and also included in the amendment to the Twin Lakes
Master Plan, all point to there being only one approved and AUAR studied scenario,
scenario #1.
Map 3 and other options are "ineffective" because of the actions of the planning
commission and Council. They are not mentioned in Resolution 9904.
Accepting Mr. Stark's interpretation of the Twin Lakes Master Plan would also require us
to conclude that:
• the Appeals Court Decision on the Twin Lakes LLC proposal is meaningless.
• the City and the Developers were wrong in stopping the project. Under Mr. Stark's
interpretation, the proposal probably would be acceptable, without any amendment to the
Twin Lakes Comprehensive Plan being necessary. Contemplate for a moment what
ramifications that might bring up.
For all of the above reasons, the proposed AUAR is inconsistent with the actual Twin Lakes
Master Plan, and the 2001 AUAR imbedded in the existing Twin Lakes Comprehensive
Plan.
(Go to next page for discussion of policy issues related to the P.U.D.B6 Comprehensive
Plan designation).
5
