If any written legal opinion exists, it <br />should be a part of this analysis. <br />CONCLUSION <br />The Twin Lakes Master Plan, as adopted June 26, 2001, and as evidenced by the <br />Master Plan attached to the June 26, 2001 minutes, and the Twin Lakes AUAR adopted <br />by Council by on the same date, and also included in the amendment to the Twin Lakes <br />Master Plan, all point to there being only one approved and AUAR studied scenario, <br />scenario #1. <br />Map 3 and other options are "ineffective" because of the actions of the planning <br />commission and Council. They are not mentioned in Resolution 9904. <br />Accepting Mr. Stark's interpretation of the Twin Lakes Master Plan would also require us <br />to conclude that: <br />• the Appeals Court Decision on the Twin Lakes LLC proposal is meaningless. <br />• the City and the Developers were wrong in stopping the project. Under Mr. Stark's <br />interpretation, the proposal probably would be acceptable, without any amendment to the <br />Twin Lakes Comprehensive Plan being necessary. Contemplate for a moment what <br />ramifications that might bring up. <br />For all of the above reasons, the proposed AUAR is inconsistent with the actual Twin Lakes <br />Master Plan, and the 2001 AUAR imbedded in the existing Twin Lakes Comprehensive <br />Plan. <br />(Go to next page for discussion of policy issues related to the P.U.D.B6 Comprehensive <br />Plan designation). <br />5 <br />
