Regular City Council Meeting <br />Monday, August 13, 2007 <br />Page 15 <br />Fire Chief Rich Gasaway displayed the graduation certificate of Dep- <br />uty Chief Peterson's achievement and recognition in completing the <br />program. <br />Mayor Klausing, on behalf of the City Council, staff and citizens, <br />congratulated Deputy Chief Peterson on this accomplishment and fur- <br />ther training benefiting the community and department. <br />b. Alcohol Compliance Checks -Consider Civil Penalties for Failed <br />Alcohol Compliance Checks <br />City of Roseville Police Chief Carol Sletner and Patrol Supervisor <br />Sergeant Matt Marshall were available to provide comment on each <br />failed compliance check. <br />City Attorney Anderson advised that the City Council should act sepa- <br />rately on each violation, in accordance with provisions in City Code, <br />Section 13.15C. City Attorney Anderson also briefly reviewed the <br />hearing procedure before an administrative appeal judge at a later <br />date, depending on responses of each business. <br />Councilmember Kough expressed his personal concern that licensees <br />take responsibility for themselves and their employees; and spoke in <br />support of the annual compliance checks, noting that the City Council <br />took compliance checks and failures very seriously. Councilmember <br />Kough reminded licensees of the training program made available by <br />the City's Police Department. <br />Police Chief Sletner reviewed the process, as detailed in her staff re- <br />port dated August 13, 2007, subsequent compliance checks of fifty- <br />seven (57) businesses, with forty-eight (48) passing and nine (9) fail- <br />ing. Chief Sletner advised the proposed penalties as set forth in City <br />Code, Section 302.15. <br />Off-Sale Licensees <br />Network Liquors <br />Chief Sletner reviewed the compliance failure incident; noted that the <br />business had participated in optional training; and that this was their <br />first violation in thirty-six (36) months. Chief Sletner recommended <br />that the City Council authorize the Police Department and City Attor- <br />ney to issue and administer the presumptive penalty, pursuant to City <br />
