Planning Commission Meeting <br />Minutes – Wednesday, June 6, 2007 <br />Page 4 <br /> <br />Commissioner Gasongo spoke in support of the application; expressing concern with <br />severe weather situations, and sought reassurances that the project would remain on <br />or ahead of schedule. <br /> <br />Commissioner Doherty concurred that a condition be that, if the new home was not <br />completed by October, that the applicant move elsewhere, excluding the garage. <br /> <br />Commissioner Boerigter opined that this was a tough decision, and that each case <br />needed to be considered on an individual basis, thus not setting precedent. <br />Commissioner Boerigter noted that with the neighbors being supportive of the <br />application, and with conditions to ensure the strict time limit; financial penalty to <br />enforce the timeframe if the RV is not removed; and ongoing inspections by City staff <br />to ensure that hookups are appropriate and that no water is being dumped on the <br />property; along with charging the applicant for electrical and utility maintenance; and <br />given the unique aspects of the site, that he was inclined to support the application. <br /> <br />Commissioner Martinson concurred with Commissioner comments. <br /> <br />Commissioner Wozniak expressed his support of redevelopment and renovation; <br />recognized the support and welcome expressed by the neighbors of the change in the <br />neighborhood and proposed use of the RV as temporary living quarters; however, <br />expressed concern about the precedent it sets and potential risk to the City for <br />approving the RV as temporary living quarters should a storm create liability issues for <br />the City, allowing the RV to be used as temporary living quarters, with no storm <br />shelter accommodations. Commissioner Wozniak opined that he would be more <br />supportive of using the garage structure as temporary living quarters, due to it being <br />more sturdy. <br /> <br />Mr. DeLeo advised that the entire project was under full risk insurance covering the <br />entire property, in addition to liability coverage on the RV. <br /> <br />MOTION <br />Member Bakeman moved, seconded by Member Doherty to RECOMMEND <br />APPROVAL of Robert DeLeo’s request for an INTERIM USE PERMIT (IUP) to use <br />his recreational vehicle (RV), or his garage, as temporary living quarters during <br />the construction of his new home, based on the comments and findings of <br />Section 5 of the project report dated June 6, 2007; <br />amended to include <br />conditions as follows: <br /> The permit will extend only to the end of October 2007, at which time the <br />? <br />applicant will vacate the temporary living quarters in the RV; <br /> The garage is excluded from use as temporary or permanent living quarters; <br />? <br /> As indicated by the Site Plan, location of the RV is to remain in the side or <br />? <br />rear yard; <br /> A financial penalty of $100/day will be assessed against the property if the <br />? <br />RV remains on the property or is lived in on the property after the expiration <br />date (October 2007); <br /> Staff will immediately inspect the RV and site to ensure appropriate <br />? <br />connections and disposal facilities for water, sewer and electricity as <br />applicable; with ongoing inspections as deemed appropriate by staff, with <br />applicable inspection fees to be paid by the applicant; <br /> As deemed appropriate by the City Attorney, the applicant will agree to sign <br />? <br />a document releasing the City from all claims; and <br /> City Code shall apply to other aspects of the property use during this time <br />? <br />(i.e., no dumping of grey water in the sanitary sewer connection in the <br />garage). <br /> <br />
