Planning Commission Meeting <br />Minutes – Wednesday, July 11, 2007 <br />Page 2 <br /> <br />recording documents were never signed and the proposed plat had since been <br />modified to include an additional lot. <br />Staff recommended APPROVAL of the EASEMENT VACATION and FINAL PLAT <br />request of Bonten LP and Bonten II LLC, based on comments and findings outlined in <br />Sections 5 and 6, and detailed conditions of Section 7 of the project report dated July <br />11, 2007. <br />City Engineer Bloom verifying that the Easement and Vacation Agreement had been <br />completed and resolved, as detailed in the staff report. <br />City Planner Paschke clarified that the Easement Vacation Condition had been <br />resolved; but that the Preliminary/Final Plat Condition remained pending. <br />The applicant, David Bonestroo, 2335 W Highway 36 <br />Mr. Bonestroo concurred with the staff report; noting that the intent of the application <br />was to set ownership entities on land belonging to them, and as configured to meet <br />parking requirements. <br />Chair Bakeman closed the Public Hearing, with no one appearing for or against. <br />MOTION <br /> <br />Member Doherty moved, seconded by Member Gasongo to RECOMMEND <br />APPROVAL of the VACATION of certain public easements, based on comments <br />of Section 4 and 5, and subject to the condition detailed in Section 7 of the <br />project report dated July 11, 2007; and to RECOMMEND APPROVAL of the <br />FINAL PLAT combining eight (8) lots and/or parcels into four (4) lots, based on <br />the comments of Section 4 and 6, and subject to the condition as detailed in <br />Section 7 of the project report dated July 11, 2007. <br />Ayes: 6 <br />Nays: 0 <br />Motion carried. <br />Chair Bakeman noted that the case would be heard at the City Council meeting <br />scheduled for Monday, July 23, 2007. <br />b. PLANNING FILE 07-029 <br />Request by Jerrold Zack for a CONDITIONAL USE PERMIT to allow an <br />accessory structure that is larger than the City Code permits outright on the <br />residential property at 2127 Cohansey Boulevard. <br />Chair Bakeman opened the Public Hearing for Planning File 07-029. <br />Associate Planner Bryan Lloyd reviewed the request of the applicant to construct a <br />960-square foot detached garage, requiring a CONDITIOANL USE PERMIT for an <br />accessory structure of this size. <br />Staff recommended APPROVAL of the request for a CONDITIONAL USE PERMIT to <br />allow construction of the proposed accessory building; based on comments and <br />findings of Sections 5 and 6, and subject to conditions detailed in Section 7 of the <br />project report dated July 11, 2007. <br />Applicant, Jerrold Zack, 2127 Cohansey Boulevard <br />Mr. Zack advised that, as per the staff report, the detached accessory building would <br />comply with the six foot (6’) easement; and the applicant confirmed with Chair <br />Bakeman that he was in agreement with all conditions outlined in the staff report. <br />Chair Bakeman closed the Public Hearing, with no one appearing for or against. <br />Discussion included public comment fielded by staff, with staff confirming that they <br />were neutral comments; and whether this lot would be large enough to split and <br /> <br />
