Planning Commission Meeting <br />Minutes – Wednesday, August 01, 2007 <br />Page 8 <br /> <br />Commissioner Gottfried concurred with the concerns expressed by Commissioner <br />Wozniak; however, opined that in general, similar issues were addressed by the Building <br />Code approvals prior to Certificates of Occupancy being issued. <br />Mr. Paschke advised that the applicant was not available for tonight’s meeting. <br />Vice Chair Doherty closed the Public Hearing with no one appearing for or against. <br />MOTION <br />Member Wozniak moved, seconded by Member Gottfried to RECOMMEND <br />APPROVAL of the request for an INTERIM USE PERMIT; for Mark Theobald, <br />allowing 2581 Fairview Avenue to be utilized as a softball and baseball training and <br />instructional facility; based on the comments and findings of Section 5, and the <br />conditions of Section 6 of the project report dated August 1, 2007; <br />amended to add <br />Condition C, directing staff to review whether ADA and Clean Air Act requirements <br />were met prior to a Certificate of Occupancy being issued and site compatibility <br />with such requirements. <br />Ayes: 5 <br />Nays: 0 <br />Motion carried. <br />Vice Chair Doherty advised that anticipated City Council action on Planning File 07-042 <br />was scheduled for August 27, 2007. <br />Mr. Paschke advised that staff would provide a follow-up in their staff report to the City <br />Council regarding ADA and Clean Air Act requirements as addressed during tonight’s <br />Planning Commission discussion. <br />c. PLANNING FILE 07-047 <br />Request by Roselawn Cemetery, 803 Larpenteur Avenue, for a CONDITIONAL USE <br />PERMIT (CUP) to allow the construction of a mausoleum facility. <br />Vice Chair Doherty opened the Public Hearing for Planning File 07-047. <br />City Planner Thomas Paschke reviewed the request of the applicant, Roselawn Cemetery, <br />to allow construction of a 40-foot by 40-foot (approximately) mausoleum on the premises, <br />which will include ninety-six (96) crypts and one hundred-eight (180) niches. Mr. Paschke <br />advised that originally, Roselawn Cemetery made application to the Permit Division to <br />construct the mausoleum; and that a component of any permit is a review by the Planning <br />Division for land use and zoning compliance. Mr. Paschke noted that, at that point, he <br />concluded that a CUP was required before the City could issue the construction permit. <br />Mr. Paschke noted that, upon further discussion with the project contractor, it was <br />determined that submission of a “Master Plan” for the cemetery be incorporated into the <br />CUP process, allowing for future permits to be issued without the need for additional <br />Public Hearing and City Council approvals. <br />Mr. Pashke noted that the proposed construction of a mausoleum would have little or no <br />impact on the surrounding community, as the construction was proposed on the interior of <br />the site, with future road extensions and an additional monument/feature near the <br />northerly access. Mr. Paschke clarified that no crematorium was indicated in the <br />Roselawn Cemetery Master Plan. <br />Mr. Paschke defined that construction of the mausoleum, on the interior of the site, would <br />be approximately 850 feet from the nearest resident (Saint Paul), would not create a <br />visual impact, and would not contribute to or increase the ambient noise in the area. Mr. <br />Paschke further noted that the mausoleum location was 780 feet north of main entry <br />(Larpenteur Avenue), 1060 feet from the west property line (Victoria Street) and 1,000 feet <br />from the east property line; and that the proposed location was adjacent to an existing <br />circular drive and monument. <br /> <br />
