EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was held on the 24t" day of September, 2007, at 6:00 p.m. The following members were present: Roe, Pust Ihlan, Kough, and Klausing; and none were absent. Council Member Roe introduced the following resolution and moved its adoption: RESOLUTION NO. 10558 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT IN ACCORDANCE WITH §1004.O1A4 AND §1013.01 OF THE ROSEVILLE CITY CODE FOR MIKE HEFFERNAN AT 893 COUNTY ROAD C2 (PF07-052) WHEREAS, Mike Heffernan is the owner of property at 893 County Road C2; and WHEREAS, the subject property is legally described as: Saint Paul Park ez N 330 ft of the E 1/3 of Lot 38 PIN: 02-29-23-24-0057 WHEREAS, the property owner seeks to construct a 1,008-square-foot accessory structure, which is a conditionally permitted use in the Single-Family Residence Zoning District; and WHEREAS, The Roseville Planning Commission held a public hearing regarding the requested CONDITIONAL USE PERMIT, voting 7-0 to recommend approval of the request based on the comments and findings of the staff report dated September 5, 2007; and WHEREAS, the Roseville City Council has determined that approval of the requested CONDITIONAL USE PERMIT will not adversely affect conditions on nearby properties and will not compromise the health, safety, and general welfare of the citizens of Roseville; NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE the request by Mike Heffernan for a CONDITIONAL USE PERMIT in accordance with Section § 1013.01 of the Roseville City Code, subject to the following conditions; 1. The footprint of the accessory structure shall not exceed 1,008 square feet, and pursuant to §1004.O1A10 (Accessory Building Height), its wall height shall not exceed 9 feet and its overall height shall be limited to 15 feet, as measured to the midpoint of the slope of the roof; 2. No additional accessory buildings will be allowed on the property;
