EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 13~' day of August 2007, at 6:00 p.m. <br />The following members were present: Ihlan, Pust, Kough, Roe and Mayor Klausing <br />and the following were absent: None <br />Council Member Klausing introduced the following resolution and moved its adoption: <br />RESOLUTION NO.10540 <br />A RESOLUTION DENYING THE CITIZEN PETITION FOR AN ENVIRONMENTAL <br />ASSESSMENT WORKSHEET (EAW) FOR THE ART MUELLER SUBDIVISION PLAT <br />OF OAK ACRES, 2201 ACORN ROAD (PF07-039). <br />WHEREAS, the City Planner received notice on July 24, 2007 that the Environmental <br />Quality Board (EQB) had received a Citizen Petition seeking an EAW on the Oak Acres four lot <br />residential subdivision at 2201 Acorn Road; and <br />WHEREAS, the EQB determined Roseville to be the appropriate Responsible <br />Governmental Unit (RGU) to decide the need for the requested EAW; and <br />WHEREAS, Minnesota Rules 4410.1100 set forth the procedures to be followed in <br />making a decision on the Citizen Petition; and <br />WHEREAS, Minnesota Rules 4410.4600, (Exemptions), subpart 12 (Residential <br />Development) lists the following projects that aze exempt from environmental review; <br />a. Construction of a sewered residential development, <br />1. Less than 10 units in an unincorporated area, <br />2. Less that 20 units in a third or fourth class city, <br />3. Less than 40 units in a second class city, or <br />4. Less than 80 units in a first class city, no part of which is within a <br />shoreland area, delineated flood plain, state or federally designated wild <br />and scenic river district, the Minnesota River Project area, or the <br />Mississippi headwaters area is exempt. <br />b. Construction of a single residence or multiple residence with four dwelling units <br />or less and accessory appurtenant structures and utilities is exempt. <br />
