WHEREAS, Oak Acres is a four lot single family residential development that will be <br />publicly sewered; and <br />WHEREAS, the City of Roseville is a second class city; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to DENY the <br />Citizen Petition for an EAW on Oak Acres based on the following: <br />a. Minnesota Rules 4411.4600 (Exemptions), subpart 12 (Residential <br />Developments) A. (3) EXEMPTS residential developments less than 40 units in a <br />second class city, no part of which is within a shoreland area, delineated flood <br />plain, state or federally designated wild and scenic river district, the Minnesota <br />River Project area, or the Mississippi headwaters area is exempt. <br />b. The Roseville City Council is not allowed under EQB Rules to require an EAW <br />because the project is exempt. <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member Pust and upon vote being taken thereon, the following voted in favor: Pust, Roe, And <br />Mayor Klausing <br />and the following voted against: Ihlan and Kough <br />WHEREUPON said resolution was declared duly passed and adopted. <br />2 <br />
