City Council Study Session <br />Monday, September 17, 2007 <br />Page 10 <br />Public Works Director Duane Schwartz noted that, when the City was <br />last inspected, there was a 2-3 page list of corrective actions to be ac- <br />complished within a certain time, without fine; however, he noted that <br />OSHA had changed their process and action since the previous in- <br />spection. <br />Discussion included annual training for employees on equipment; hir- <br />ing of a new Loss-Control Advisory Consultant; initiation of an effort <br />to re-assess the role of the City's internal Safety Committee; request <br />of $50,000 in the City Manager-Recommended Budget to replace <br />non-OSHA-approved equipment; and efforts to meet OSHA man- <br />dates. <br />Ms. Davitt thanked Councilmembers for their support of the $50,000 <br />budget allotment for 2008 for equipment replacement and/or repairs; <br />and their approval of a new Loss-Control Advisory Consultant. Ms. <br />Davitt advised Councilmembers that, through that intent and those ini- <br />tiatives, staff was able to negotiate with OSHA to reduce fines by over <br />sixty percent (60%). <br />Additional discussion included inadequacies and lack of current train- <br />ing and procedures based on OSHA requirements of past loss control <br />consultants. <br />Mayor Klausing requested that City Attorney Jay Squires review with <br />Ms. Davitt the contract with the previous. consultant to determine if <br />there was any breach of contract issues. <br />Councilmember Pust suggested that, beyond breach of contract issues, <br />the City be responsible with reference opportunities for previous con- <br />sultants, to protect other potential clients. <br />Councilmember Pust questioned staff on other items, beyond the <br />$50,000 already allotted, that may need to be addressed immediately <br />or within the 2008 budget to bring the City into compliance. <br />City Manager Malinen advised that the $50,000 would serve as a <br />placeholder for the time being, allowing more time for detailed analy- <br />sis by staff on other potential equipment needs <br />
