City Council Study Session <br />Monday, September 17, 2007 <br />Page 23 <br />online Council packet, or one copy made available in the room on the <br />night of Council consideration. <br />Northwestern College Update <br />PUD Amendment <br />City Manager Malinen provided an update, following the City Attorney's <br />meeting with Northwestern College representatives last Friday, and staff's <br />meeting with Northwestern College earlier today, of ongoing negotiations <br />for language for the PUD Agreement; with only one (1) item remaining un- <br />resolved. Mr. Malinen noted that if agreement was not reached, staff rec- <br />ommended as well as college-preferred language may both be submitted to <br />the City Council for their consideration. <br />Environmental Litigation <br />City Manager Malinen advised that staff was working with the League of <br />Minnesota Cities Insurance Trust (LMCIT) on selecting new counsel well- <br />versed on environmental issues. The plaintiff's attorney had been provided <br />with the City's answer to the claim of the plaintiff, Friends of Twin Lakes, <br />challenging the City Council's negative declaration of the need for an Envi- <br />ronmental Assessment Worksheet (EAW). <br />Staff was requested to provide Councilmembers with a copy of the City's <br />answer to the claim; and to provide them with the name of the plaintiff's at- <br />torney. <br />6.
