A <br />request for a written advisory opinion may be made only by aI1 individual <br />that wishes to use the apinion to guide the individual's own conduct. <br />2. Requests must be iI1 writing. Requests for fol-Ima1 advisory opinions shall <br />be in wl-iting and must set out with reasonable speciflcity the facts and <br />circumstances of a real case. Requests for advisory opinions shall be filed <br />with the City Attorney, who shall assist any person requesting an advisory <br />opinion in prepal-ing the request. <br />3. Discretion to issue. The City Attorney shall expeditiously detel-111ine <br />whether to issue a written advisory opinion addressing the issues raised. <br />The City Attorley may detel-Imille that Ito opinion maybe given, or that an <br />illfornlal opinion will be rendered. The City Attorney will advise the person <br />requesting the opinion of his/her decision under this provision. <br />4. Issuance. If the City Attorley determines that he/she shall issue an <br />adVlSOry Opllm011, It Shall be prepared In WI"lung, and shall be forwarded to <br />the person requesting it and to the City Attol-lzey, City Manager and Ethics <br />Commission. The Ethics Commission may publish an opinion or a <br />Sumlmary Of all Opll11o11, but any SUCK publlSlled Op1111on Ol" SUI11111a1"y of all <br />Oplnloll, C011slstent Wltl1 the 1VIln1leSOta GOVe17ll11e11t PractlCeS Act, a11d ally <br />other applicable law, may not include the name of the requestor, or any <br />other information that might identify the requestor. <br />5. Effect. When a fol-mal advisory opinion is issued, a person that acts in <br />confol-I11ity with the written advisory oplnioll shall not be subject to any <br />
