Resolution and Ordinance -Consider Adopting a Resolution Revising the <br />Prosecuting Attorney Contract and Enacting an Ordinance Amending Title <br />4, Sections 407.05, City Council May Enforce: and 407.06, Powers of Officers <br />Building Codes Coordinator Don Munson had provided a bench handout respond- <br />ing to questions asked by Councilmember Dan Roe following receipt of the <br />Council packet last week, along with a list of current and ongoing problem land <br />use enforcement cases. <br />Mr. Munson noted that staff had previously been directed by the City Council to <br />provide proposed changes to the prosecuting attorney contract and City Council to <br />speed resolution of land use violations (those requiring the issuance of a Ramsey <br />County Court Citation); and more clearly define City Code enforcement authority. <br />The staff report addressed proposed changes; fiscal implications; and staff rec- <br />ommendations; along with a draft resolution and draft ordinance as applicable. <br />Discussion included clarifying when the City Council would still be involved <br />(abatement process issues); rationale for pursuing a quicker citation process, <br />rather than deferring the process for public hearing before the City Council; pref- <br />erence of most property owners not in compliance to resolve an issue prior to the <br />case being heard before a judge; and the habitual nature of most problem proper- <br />ties. <br />Ihlan moved, Klausing seconded, adoption of a resolution amending the current <br />prosecuting attorney contract to eliminate Item Number 18 related to land use en- <br />forcement. <br />
