Roe moved, Ihlan seconded, a motion to amend the proposed ordinance revised language to Section 407.06, Part A as follows: "Notice: Whenever an officer charged with enforcement determines that a public nuisance is being maintained or exists on premises in the City, [and determines that the City abatement process is appropriate], the officer shall notify, in writ- ing, the owner or occupant of the premises of such fact and order that such nui- sance be terminated or abated." Roe moved, Pust seconded, directing the Housing and Redevelopment Authority (HRA) to provide a study of the existing code enforcement process and report back to the City Council at their earliest opportunity. Mayor Klausing expressed his frustration, and sought clarity on what the City Council was directing the HRA to do, and what was to be accomplished. Councilmember Roe withdrew his motion. Councilmember Ihlan requested, in order to have an informed discussion at a fu- ture Council meeting, that staff provide updated research on the code enforcement process to-date; information on alternatives; and comparison processes with other communities. d. Discussion -Discuss Public Notification Requirements for Zoning and Land Use Public Hearings Interim Community Development Director Mike Darrow sought a clarification from the City Council on notification requirements pertaining to zoning and land use public hearings. Mr. Darrow reviewed Minnesota Law as set forth in State Statue 462.357; past City practice; current City practice; and notification policies and practices of other metropolitan communities.
