eg Iar ity o ci eeti <br />oday, cto er , 2007 <br />Page I <br />ing, the owner or occupant of the premises of such fact and order that such nui- <br />sance be terminated or abated." <br />Roe moved, Ihlan seconded, a motion to amend the proposed ordinance revised <br />language to Section 407.06, Part A as follows: <br />"Notice: Whenever an officer charged with enforcement determines that a public <br />nuisance is being maintained or exists on premises in the City, [and determines <br />that the City abatement process is appropriate], the officer shall notify, in writ- <br />ing, the owner or occupant of the premises of such fact and order that such nui- <br />sance be terminated or abated." <br />Roll Call <br />Ayes: Ihlan; Roe; Pust; and Klausing. <br />Nays: Kough. <br />Motion carried. <br />Roll Call <br />(original motion as amended) <br />Ayes: Ihlan; Roe; and Klausing. <br />Nays: Kough and Pust. <br />Motion carried. <br />Roe moved, Pust seconded, directing the Housing and Redevelopment Authority <br />(HRA) to provide a study of the existing code enforcement process and report <br />back to the City Council at their earliest opportunity. <br />Mayor Klausing expressed his frustration, and sought clarity on what the City <br />Council was directing the HRA to do, and what was to be accomplished. <br />Councilmember Roe withdrew his motion. <br />Councilmember Ihlan requested, in order to have an informed discussion at a fu- <br />ture Council meeting, that staff provide updated research on the code enforcement <br />process to-date; information on alternatives; and comparison processes with other <br />communities. <br />d. Discussion -Discuss Public Notification Requirements for Zoning and Land <br />Use Public Hearings <br />Interim Community Development Director Mike Darrow sought a clarification <br />from the City Council on notification requirements pertaining to zoning and land <br />use public hearings. <br />Mr. Darrow reviewed Minnesota Law as set forth in State Statue 462.357; past <br />City practice; current City practice; and notification policies and practices of other <br />metropolitan communities. <br />
