Council Discussion of City Code Enforcement <br />This item was removed by staff to allow provision of additional information at a <br />later meeting for City Council review and consideration. <br />e. Consider request of Community Development Department to issue Ramsey <br />County Court Citation against the Owner of 2967 Galtier Street for a Public <br />Nuisance Violation <br />At the request of Mayor Klausing, City Building Codes Coordinator Don Munson <br />advised that the final remaining violation, a commercial dump truck in the drive- <br />way, had been resolved and removed. <br />Mayor Klausing sought assurances that additional or recurrent violations would <br />not occur if the City Council didn't authorize issuance of a citation. <br />Mr. Munson advised that the property owner, in the past, had complied, and of- <br />fered the owner the benefit of the doubt, based on discussions with and apparent <br />intents for compliance by the owner. Mr. Munson noted, however, that the same <br />compassion would not apply if there were repeat violations in the future. <br />f. Consider request of Community Development Department to issue Ramsey <br />County Court Citation against the owner of Rental Property at 2040-42 <br />Brenner Avenue for ongoing Public Nuisance Violations <br />Mr. Munson noted that a representative of the property owner was present tonight <br />to speak. <br />Mr. Don Munson reviewed the various repeat violations and their status at this <br />property, in addition to ongoing and repeat complaints from the neighbors; lack of <br />compliance due to disputes between the property owner and tenants as to who was <br />the responsible party; current violations remaining as of earlier today of an unli- <br />censed vehicle and a spare tire on the property. <br />Mr. Munson reviewed options before the City Council, and staff's recommenda- <br />tion that the Council authorize staff to work with the Prosecuting Attorney to is- <br />sue aRamsey County Court Citation against the owner of rental property at 2040- <br />42 Brenner Avenue for ongoing public nuisance violations. Mr. Munson noted <br />that it would be recommended to the judge that a fine and jail time be provided, <br />due to past and ongoing violations, with that sentence stayed if no more violations <br />occurred within the next twelve (12) months and to emphasize the need for the <br />property owner to take responsibility for the condition of his property. <br />Discussion included the court citation process and monitoring compliance; and <br />ongoing violation history of this property. <br />
