Regular City Council Meeting <br />Monday, November 19, 2007 <br />Page 5 <br />Klausing moved, Ihlan seconded, adoption of Resolution No. 10568 entitled, "A <br />Resolution Establishing a Procedure for Advisory Ethics Opinions," with amend- <br />ments to Attachment A as indicated in the previous motion. <br />Roll Call <br />Ayes: Roe: Pust; Kough; Ihlan; and Klausing. <br />Nays: None. <br />b. Enact an Ordinance Amending Title Five, Chapter 501 of the City Code en- <br />couraging Sterilization of Domestic Animals and Compliance with the City`s <br />Licensing Requirements (Former Consent Item 8.e) <br />Councilmember Ihlan referenced the League of Minnesota Cities (LMC) model <br />animal ordinance and memos supporting that model, regarding providing notice to <br />owners of impounded animals; and sought to have that included in the proposed <br />ordinance, to ensure due process. <br />Councilmember Ihlan further addressed provisions for confining animals. in heat, <br />as previously requested by Carol Kough; and questioned why that language had <br />been removed from the proposed ordinance, and only referenced that no animals <br />should be allowed to run at-large. <br />Mayor Klausing opined that the extra language seemed redundant; however, de- <br />ferred to Councilmember Pust, who had worked extensively on this proposed or- <br />dinance revision. <br />Councilmember Pust opined that the language had been revised that no animal <br />should be allowed to run at-large, whether in heat or not; however, agreed to rein- <br />state the language. <br />lhlan moved, Kough seconded, amendment to the ordinance, and publication <br />summary as applicable to include language in Section 501.10 (Impounding) to <br />now read: <br />"Any dog of cat found running at large or without valid tags displayed, off the <br />owner's premises, may be seized and may be impounded. All animals found to <br />be a nuisance under Section 501.03 may be impounded. Any police officer <br />may impound any dog or other animal found unlicensed or any animal <br />found running at large and shall give notice of the impounding to the owner <br />of such dog or other animals, if known. In case the owner is unknown, the <br />ofr'icer shall post notice at City {Hall} Affise that if the dog or other ani- <br />mal is not claimed within the time specified in this subdivision, it will be <br />sold or otherwise disposed of.] All animals impounded shall be kept with hu- <br />mane treatment and sufficient food and water for their comfort for at least five (5) <br />regular business days, [as defined in Minnesota Statute, Section 35.71, Subd. 3], <br />unless the animal is a dangerous animal as defined under Minnesota Statutes, <br />Sections 347.50 to 347.54, in which case it shall be kept for seven days, and ex- <br />cept if the animal is acruelly-treated animal under Minnesota Statutes, Section <br />343.235, in which case it shall be kept for ten (10) days, unless sooner reclaimed <br />by the owner or returned to the owner.
