Regular City Council Meeting <br />Monday, December 17, 2007 <br />Page 7 <br />Mrs. V. Ramalingam, 2182 Acorn Road <br />Mrs. Ramalingam noted that, while they had not received notice, but that the <br />property in question was within 400' of their property; and opined that it had been <br />represented to them as one thing, then presented to the City Council as another <br />thing, with doubling in size and no Planning Commission discussion. Ms. Rama- <br />lingam expressed frustration that the project was changed in public, with no op- <br />portunity to make comment that held any weight, or for orderly discussion. <br />Mayor Klausing clarified that the prior Council action on the Mueller subdivision, <br />and this particular action before the Council were separate issues. <br />Mrs. Ramalingam opined that the proposed ordinance amendment didn't consider <br />snow removal, or large emergency vehicles, or other practical issues. <br />Mayor Klausing offered to discuss, outside the meeting parameters, Mrs. Rama- <br />lingam's concerns with past Council action on the Mueller subdivision and the <br />process followed. <br />Councilmember Ihlan noted the time, and opined that the City Council would at- <br />tempt to "ram through on a 3/2 vote," this action, without further policy discus- <br />sion and more adequate deliberation. <br />Ihlan moved, Kough seconded, tabling this item. <br />Mayor Klausing ruled the motion out of order, based on the previously failed mo- <br />tion of the maker of this motion. <br />Mr. Schwartz reiterated staff's purpose in the recommendation before the Coun- <br />cil to provide compliance of existing cul-de-sacs with code criteria; and noted that <br />the Council would continue to ultimately approve any substandard cul-de-sacs; <br />with staff taking fire codes, impacts to properties, storm water systems and other <br />issues into consideration before making a recommendation to the City Council. <br />City Attorney Squires concurred with staff s synopsis and recommendation, based <br />on recent court findings. City Attorney Squires noted the difficulty and frustra- <br />tion to reference materials, without clarifying the actual document to allow re- <br />view; however noted that the recommended code amendment language was con- <br />sistent with State law as per his research. <br />Mayor Klausing opined that staff s recommendation appeared prudent to avoid a <br />more cumbersome process and meet legal standards; and that in situations where <br />smaller cul-de-sacs are considered it usually was for environmental purposes to <br />avoid greater impacts to the surrounding land area (i.e. wetlands). <br />
