Planning Commission Meeting <br />Minutes -Wednesday, November 07, 2007 <br />Page 4 <br />Chair Bakeman noted that previous Commission discussion included incorporating <br />"sustainability" and "environmental impact" language; however, it was Planning <br />Commission consensus after further discussion, that the language remain as provided. <br />Chair Bakeman closed the Public Hearing. <br />MOTION <br />Member Wozniak moved, seconded by Member Bakeman to SUPPORT AND <br />RECOMMEND ADOPTION OF AMENDMENTS to the City's Zoning Code (Title 10) <br />and Subdivision Code (Title 11); as outlined and detailed in the project report dated <br />November 7, 2007; amended to include consistency language clarification and <br />definitions as discussed this evening. <br />Ayes: 7 <br />Nays: 0 <br />Motion carried. <br />b. PLANNING FILE 07-053 <br />Request by Emmes Realty Services LLC (Gateway Washington Inc., property <br />owner) for an AMENDED PLANNED UNIT DEVELOPMENT at Har Mar Mall, 2100 <br />Snelling Avenue; pertaining to the redevelopment of the Firestone building and <br />surrounding area. <br />Chair Bakeman opened the Public Hearing for Planning File 07-053. <br />City Planner Paschke reviewed the request of Emmes Realty Services LLC (Emmes) to <br />AMEND the PLANNED UNIT DEVELOPMENT established in January of 2000, to relocate <br />the northeastern outlot (currently Firestone) to a location adjacent to County Road B, and <br />northerly access into the site. <br />Mr. Paschke reviewed the history of the shopping center district moratorium; heightened <br />requirements for 24-hour uses within 300' of residentially-zoned property as a base plan <br />to work with Shopping Center Districts for inclusion of more detailed site development <br />standards by use of Planned Unit Development (PUD) processes. <br />Mr. Paschke clarified that proposed improvements that are components of this application <br />include: razing the Firestone building and constructing an additional parking lot in its <br />place; creating a new outlot/structure adjacent to County Road B; modifying the entry road <br />at the signalized intersection with County Road B; and modifying the drive land ring road <br />that intersects with the signalized access to County Road B. <br />Mr. Paschke reviewed specifics of each of those components, as detailed in the staff <br />report. <br />Staff recommended APPROVAL of the requested PLANNED UNIT DEVELOPMENT <br />AMENDMENT for Har Mar Mall to redevelop the Firestone site with a new outlot/structure <br />adjacent to County Road B; based on comments in Section 6 and numerous conditions of <br />Section 7 of the project report dated November 7, 2007. Mr. Paschke advised that the <br />traffic mitigation condition recommendation in the staff report be modified to <br />include, rather than full closure as previously recommended by staff, and following <br />discussion and compromise by staff and the applicant earlier this afternoon, that <br />the applicant, at a minimum, close the ripht-out closinp (east), and that a ripht-in- <br />only be provided, with the exit eliminated at that access point. <br />City Engineer Debra Bloom provided a detailed review of current traffic issues at that <br />intersection, with lunch time patrons taking aright-out and u-turning at that specific <br />intersection, creating substantial issues and concerns for the Police Department during <br />this busy time of day, particularly with larger vehicles unable to successfully complete the <br />u-turn radius. Ms. Bloom noted access changes made during reconstruction of Target <br />One for access to the Midas and Car Wash properties; posting of "No U-Turn" signs <br />during certain hours at the intersection to no avail; and additional trips projected in the <br />traffic study with Har Mar Mall improvements as proposed. <br />
