Variance Board Meeting City Council Chambers, 2660 Civic Center Drive Draft Minutes - Wednesday, September 05, 2007 1. Call to Order Chair Daniel Boerigter called to order the Variance Board meeting at 5:32 p.m. and reviewed the role and purpose of the Variance Board. 2. Roll Call & Introductions City Planner Thomas Paschke called the Roll. Members Present: Chair Daniel Boerigter; and Commissioners Barbara Martinson and Jim Doherty. Commissioner Thomas Gottfried was also present in the audience. Staff present: City Planner Thomas Paschke; and Associate Planner Bryan Lloyd. 3. Approval of Minutes MOTION Member Doherty moved, seconded by Member Martinson, to approve meeting minutes of August 1, 2007 as presented. Ayes: 2 Nays: 0 Abstentions: 1 (Boerigter) Motion carried. 4. Public Hearings a. PLANNING FILE 07-049 Request by Nicholas King, 1728 Lindy Avenue, for a VARIANCE to Roseville City Code, §1012 (General Requirements) to allow a fence that is taller than the Code permits along the rear and side property lines. Chair Boerigter opened the Public Hearing for Planning File 07-049. Associate Planner Bryan Lloyd reviewed the request of Mr. and Mrs. King, to allow construction of a fence greater than 6.5 feet tall on their residential property. Mr. Lloyd advised that retail properties abut the applicants’ property to the east (Lexington Plaza Shoppes) and south (Arthur’s Jewelers); and along with the Kings’ desire for increased privacy and security prompting the variance request. Mr. Lloyd advised that new commercial developments are required by City Code to have an eight foot (8’) privacy fence to screen adjacent residential properties, and the Building Official was able to require that height requirement at Lexington Plaza Shoppes. However, Mr. Lloyd noted that, regulatory tools didn’t compel Arthur’s Jewelers property to install a similar fence it not seeking other approvals. Mr. Lloyd noted that the additional height would serve the purposes of the King’s while providing uniformity in appearance. Staff recommended APPROVAL of a 1.5 foot VARIANCE to Roseville City Code, §1012.02B(3) (Legal Encroachments) to allow to allow a fence that is taller than the Code permits along the rear and side property lines; based on the comments and findings of Section 5 and the conditions of Section 6 of the project report dated September 5, 2007. The applicant was present, but had no comment. Chair Boerigter closed the Public Hearing, with no one appearing for or against.
