Variance Board Meeting <br />Minutes – Wednesday, October 03, 2007 <br />Page 2 <br /> <br />improvements on the lot, no one had mentioned this pre-existing condition or sought <br />removal. <br />Discussion included impervious lot calculations and coverage with or without the <br />shed; staff rationale for recommending removal of the shed to meet setback <br />requirements and common staff recommendations to address other non-conforming <br />issues on a subject property when considering other land use applications; and <br />whether comment had been received from the resident immediately to the south of the <br />subject property. <br />Mr. Livingston provided written comment from Tim and Sandra Fromm, 2570 Dunlap <br />Street, which Mr. Lloyd read into the record, attached hereto and made a part <br />thereof. Mr. and Mrs. Fromm wrote in support of Mr. Livingston’s request to build a <br />garage; and advised that they had no concerns with the existing shed remaining <br />between their properties. Mr. and Mrs. Fromm appealed to the City to remove the <br />stipulation of moving or destroying the shed prior to building the garage. <br />Mr. Lloyd advised that the Board may wish to add a condition to any approval, <br />allowing the driveway to encroach to within four feet (4’) of the property line for one <br />foot (1’) of the driveway is indicated during the construction process; which would be <br />closer than the five foot (5’) sideyard setback, depending on the location of the garage <br />door. <br />Mr. Livingston advised that he planned to off-set the garage door to the south so the <br />width of the garage was one foot (1’) to the south; with the garage door at nine feet <br />(9’); allowing four feet (4’) plus one foot (1’) to the property line. Mr. Livingston noted <br />that the driveway skit may overlap by a foot; but would be a minimum of four feet (4’) <br />from the property line. <br />Commissioner Doherty confirmed that the driveway would not be closer than five feet <br />(5’) to the property line, and spoke in support of allowing the extra foot; however, was <br />not supportive of any additional non-conformities, <br />Chair Boerigter closed the Public Hearing, with no one appearing for or against. <br />MOTION <br /> <br />Member Doherty moved, seconded by Member Boerigter to adopt Variance <br />Board Resolution No. 71 entitled, “A Resolution APPROVING A VARIANCE to <br />Roseville City Code,§1004 (Residence Districts), for Alan and Linda Livingston, <br /> <br />2574 Dunlap Street (PF-07-057);” allowing for construction of a garage at least <br />one foot (1’) from the northern property line; based on based on the comments <br />and findings of Section 5 and the conditions of Section 6 of the project report <br />dated October 3, 2007; <br />amended to DELETE existing Condition 6.1.c; and <br />replacing Condition C as follows: “To allow the driveway to encroach within <br />four feet (4’) of the property line to accommodate one foot (1’) of driveway if <br />needed. <br />Ayes: 3 <br />Nays: 0 <br />Motion carried. <br />Acting Chair Boerigter advised the applicant of the appeal process timeframe. <br />b. PLANNING FILE 07-056 <br />Request by Christine Mueller, 407 N McCarrons Boulevard, for a VARIANCE to <br />Roseville City Code, §1004 (Residence Districts) to allow an expansion of the <br />principal structure that would encroach into the required setback from a <br />property line adjacent to a street right-of-way. <br />Chair Boerigter opened the Public Hearing for Planning File 07-056. <br /> <br />
