<br /> <br />Variance Board Meeting <br />City Council Chambers, 2660 Civic Center Drive <br />Minutes - Wednesday, November 07, 2007 <br />1. Call to Order <br />Chair Daniel Boerigter called to order the Variance Board meeting at 5:30 p.m. and reviewed <br />the role and purpose of the Variance Board. <br />2. Roll Call & Introductions <br />City Planner Thomas Paschke called the Roll. <br />Members Present: Chair Daniel Boerigter; Commissioners Barbara Martinson; and Jim <br />Doherty. <br />Commissioner Thomas Gottfried was also present in the audience. <br />Staff present: City Planner Thomas Paschke; Associate Planner Bryan Lloyd; City Engineer <br />Debra Bloom; and Economic Development Associate Jamie Radel. <br />3. Approval of Minutes <br />MOTION <br />Member Doherty moved, seconded by Member Martinson, to approve meeting minutes <br />of October 03, 2007 as presented. <br /> Ayes: 3 <br />Nays: 0 <br />Motion carried. <br />There was no comment from the public on items not on the agenda. <br />4. Public Hearings <br />a. PLANNING FILE 07-059 <br />Request by Chet and Joann Kurtz, 3015 S Owasso Boulevard, for a VARIANCE to <br />Roseville City Code, §1004 (Residence Districts) to resolve the existing, non- <br />conforming side yard setbacks of the principal structure and driveway. <br />Chair Boerigter opened the Public Hearing for Planning File 07-059. <br />Associate Planner Bryan Lloyd reviewed the request of Mr. and Mrs. Kurtz, and provided <br />a background on recent survey comparisons with older ones indicating that the Kurtz’s <br />attached garage was inadvertently constructed as close as 2.8 feet from the south <br />property line, and that the driveway extended over the property line and onto the <br />neighboring property, by up to 12.5 feet. <br />Mr. Lloyd advised that earlier this year, the Kurtz’s were co-applicants with the <br />neighboring property owners in a request to relocate the common property boundary as a <br />means to rectify the existing non-conformities. Mr. Lloyd noted that, while the application <br />had been approved, the land is not proposed to be transferred, and that instead the <br />Kurtz’s are attempting to resolve the nonconforming conditions while maintaining the <br />existing property boundary. <br />Mr. Lloyd advised that it was the applicant’s intent to remove driveway pavement to <br />achieve a minimum 2.8 foot separation from the southern property line, and that the <br />applicant has further requested variances to bring the substandard setbacks of the <br />reduced driveway and the existing principal structure into compliance with City Code. <br />Mr. Lloyd advised that, as City Code, Section 602.04 (Parking on Boulevard Prohibited), a <br />condition of approval was that the applicant remove the unpermitted concrete parking <br />space that had been recently paved in the South Owasso Boulevard right-of-way prior to <br />January 1, 2008. <br /> <br />
