<br />e. Consider a Planned Unit Development Agreement for Emmes Realty Ser-
<br />vices LLC pertaining to 11ar Mar Mall, 2100 Snelling Avenue (PF07-053 and
<br />PF07-062)
<br />Pust moved, Roe seconded, approval of the Har Mar Mall Planned Unit Devel-
<br />opment (PUD) Agreement between the City of Roseville and Gateway Washing-
<br />ton, Inc., by its agent Emmes Realty Services, LLC, 2100 N Snelling Avenue,
<br />Roseville, MN; as referenced in City of Roseville Project Files #PF07-053 and
<br />07-062; amended as follows:
<br />^ All references (9.4, 9.10, et al) to the building height shall state: "The maxi-
<br />mum building height shall not exceed thirty-five feet (35')."
<br />^ Item 9.5 -revised to read: "The Parties hereto recognize that the City, as a
<br />part of the PUD approval process, has studied the continuing safety of County
<br />Road B westerly driveway in light of the improvements proposed as a part of

<br />~. [While not requiring closure of this ingress/egress as a part of
<br />the approval of the PUD Amendment, the parties acknowledge that the City
<br />does not waive, and hereby retains, an~ght which it may have under appli-
<br />cable law to require closure of the ingress and/or egress from such westerly
<br />driveway in the future should the City determine, in its reasonable discretion,
<br />that traffic safety considerations warrant it.]"
<br />^ Item 9.11 - "Har Mar is the only property served by the easterly leg of the
<br />Snelling/Skillman Avenue intersection and receives a direct benefit by its safe
<br />tan efficient operation. As a result the DEVELOPER shall pay, as an assess-
<br />ment, fifty percent (50%) of the City's cost participation in the Skill-
<br />man/Snelling Avenue 2008 Minnesota Department of Transportation
<br />(MnDOT), project # ,signal replacement project, not to exceed
<br />$30,000.00."
<br />^ Item 9.12 revised to include the following language:
<br />"Prior to review by the DRC and prior to the issuance of any building permits,
<br />those specific plans for redevelopment of the Backyard Grill area, adjacent
<br />property owners -specifically those residential areas to the south previously
<br />noticed for Public Hearing purposes related to PF07-062 -will be provided an
<br />opportunity for review and comment of those redevelopment plans. This does
<br />not constitute another Public Hearing, but serves as a public informational
<br />meeting for the benefit of those residential property owners; with residents
<br />encouraged to comment by e-mail, phone or in person with staff; with those
<br />comments forward to the DRC for their consideration in reviewing the final
<br />plans .
