3. Invitations: The applicant shall prepare a printed invitation indentifying the date <br />time, place, and purpose of the open house and shall mail the invitation to the reci Tents <br />m a list prepared and provided in electronic format by Community Development <br />Department staff. The recipients will include pro erty owners within five hundred feet <br />(500'1 of the subiect property members of the Planning Commission and City Council <br />and other community members that have registered to receive the invitations <br />5. Summary: A written summary of the open house shall be submitted as a necessary <br />component of an application for interim use approval <br />~D. Application: Applications for interim uses shall be processed in the same manner as <br />conditional use permits as established in Section 1014.01 of this Title. Chapter 1016 is hereby amended as follows: <br />1016.01: Rezoning Application <br />1016.02: Open House <br />~-1-Fr.A-~ 1016.03: Hearing before Planning Commission <br />~H~3-: 1016.04: Hearing before City Council <br />A~ 1016.05: Referral to Planning Commission <br />~8~-Fr.9-~ 1016.06: Rehearing <br />1016.01: REZONING APPLICATION: <br />A. Amendment by City Council: The City Council may amend this zoning code in <br />accordance with Minnesota statutes 462.357, subd. 2. The City Council may amend the <br />official zoning map upon a majority vote of all members of the City Council. (Ord. 1255, <br />11-26-2001) <br />B. Application; Property Certificate: Any person owning real estate in the city may file an <br />application with the city manager in the form of a written request or petition to rezone <br />petitioner's real estate or such real estate abutting thereto. The application shall be <br />accompanied by an abstractor's certified property certificate showing the property owners <br />within three hundred fifty feet (350') of the outer boundaries of the land proposed to be <br />rezoned. The city manager shall refer such written application together with abstractor's <br />certified property certificate to the City Council. <br />C. Referral to Planning Commission: If the application is in the form of a petition and <br />contains the signatures of fifty percent (50%) of the property owners abutting the land <br />affected, the City Council shall refer the application and related information to the <br />planning commission. Any other application maybe referred by the City Council to the <br />planning commission or returned to the applicant. The City Council may, of its own <br />motion, initiate the request for rezoning and refer the same to the planning commission. <br />(Ord. 727, 4-29-1974) <br />Page 4 of 6 <br />
