EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, State of Minnesota, was held on the 24~' day of March, 2008 at <br />6:00 p.m. <br />The following members were present: Pust, Ihlan, Roe, and Klausing; <br />and Kough was absent. <br />Council Member Roe introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 10610 <br />A RESOLUTION APPROVING AN INTERIM USE PERMIT IN ACCORDANCE WITH <br />§1012.09 OF THE ROSEVILLE CITY CODE FOR MICHAEL SCHUELLER AND <br />CATHERINE AND RIAZ HUSSAIN, 1901 LEXINGTON AVENUE (PF08-008) <br />WHEREAS, Michael Schueller, in cooperation with property owners Catherine and Riaz <br />Hussain, has requested an INTERIM USE PERMIT in accordance with § 1012.09 of the <br />Roseville City Code on property addressed at 1901 Lexington Avenue; and <br />WHEREAS, the subject property is legally described as: <br />Section 15 Township 29 Range 23 subject to highway and street part of the N'/o of the NE <br />'/+ of the SE '/a E of Ed Bossard's Addition Plat 2 and S of a line beginning on the E line of <br />said '/. '/ and 183 feet S from the NE corner thereof thence W at a right angle 89 feet thence <br />N and parallel with said E line 18 feet thence W at right angle to E line of said Plat <br />PIN: 15-29-23-41-0030 <br />WHEREAS, the applicant with the support of the property owner seeks to establish a deli <br />and catering facility to operate within permitted business hours; and <br />WHEREAS, Michael Schueller seeks the requested INTERIM USE PERMIT to utilize <br />the existing building, the interior of which would be modified with a commercial kitchen, sales <br />and dining area; and <br />WHEREAS, The Roseville Planning Commission held a public hearing regarding the <br />requested INTERIM USE PERMIT, voting 5-0 to recommend approval of the request based on <br />the comments and findings of the staff report dated March 5, 2008; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE <br />the request by Michael Schueller and Catherine and Riaz Hussain for an INTERIM USE <br />PERMIT in accordance with Section § 1012.09 of the Roseville City Code, subject to the <br />following conditions; <br />Page 1 of3 <br />
