2. Setback is measured from the wetland or pond boundary. <br />3. One water- oriented accessory structure designed in accordance with subsection 1017.17C of this chapter <br />may be set back a minimum distance of 10 feet from the ordinary high water level. <br />4. See subsection ~tN-E~ 1 O 17.17G of this chapter. <br />5. A 30 foot setback from road or parking surfaces may include a combination of land within rights of way and <br />adjacent to the right of way, as well as curb and gutter controlling runoff and sediment to a storm pond. Pedestrian <br />trails shall be exempt from setback requirements. <br />471 <br />472 B. Additional Structure Standards for All Districts: <br />473 3. Fences: In bluff impact, shoreland, and wetland zones, fences shall be set back the same <br />474 distance from the shoreline as required for the principal structure or attached deck on the lot, <br />475 except that a fence on a lot with a preexisting principal structure and attached deck may <br />476 extend to the same setback as the deck or the structure. Fences shall be of similar design, <br />477 texture, and color as the principal structure or shall be of an earth tone or color and material. <br />478 Fences used for safety or containment maybe set within twenty five feet (25') of the <br />479 OHWL. Such fences shall be a maximum of twenty five percent (25%) opaque, and no <br />480 more than forty two inches (42") in height. Such fences shall be clad in earth tone <br />481 coatings. <br />482 With the exception of regulations in this subsection, fences in bluff impact, shoreland, <br />483 I and wetland zones shall meet all height and setback requirements of section ~3-f1~1 ~ 1()13.02 <br />484 of this title. Fences placed on the road side of a lot with water or wetland frontage shall <br />485 ~ comply with front yard fence requirements of section -1-A-11013.02 of this title. (Ord. <br />486 1270, 9-23-2002) <br />487 ~ ~-X1.017.17: GENERAL DESIGN CRITERIA FOR STRUCTURES: <br />488 A. Low Floor Elevations: All habitable structures constructed within the overlay district shall <br />489 be built with their lowest floor, including basement, no lower than the following elevation <br />490 criteria, whichever provides the greater degree of protection as determined by the city <br />491 engineer: <br />492 ~ 3. At least three feet (3') above the "wetland boundary" as defined in Section -1~1-6101.7.05 <br />493 of this Chapter. <br />494 C. Permitted Water-Oriented Accessory Structures: Each lot may have one water-oriented <br />495 nonhabitable accessory structure not meeting the normal structure setback in subsection <br />496 ~ -1-9-1 fi1017.16A of this Chapter if this water-oriented accessory structure complies with the <br />497 following provisions: <br />498 F. Steep Slopes, Visibility and Erosion: The Public Works and Community Development <br />499 Directors shall evaluate possible soil erosion impacts and development visibility from public <br />500 waters prior to issuance of a permit for construction of roads, driveways, structures, or other <br />501 improvements on steep slopes. An erosion and sedimentation control plan shall be prepared <br />502 ~ as required by Chapter !'1.018: Erosion and Sedimentation Control Ordinance. When <br />503 necessary, conditions shall be attached to the permit to preserve existing vegetation, <br />504 screening of structures, vehicles, and other facilities as viewed from the surface of public <br />505 waters, assuming summer, leaf-on vegetation.
