Regular City Council Meeting <br />Monday, March 24, 2008 <br />Page 10 <br />Councilmember Roe noted that, after the City Council's approval of their Rules of Proce- <br />dure and the Agenda's order of business, he observed a gap between the public hearings <br />and land use cases, and concurred. that revisions of the order of business may be prudent. <br />By consensus, staff was requested to add this discussion to a future agenda. <br />11. Public Hearings <br />b. Public Hearing for Off-Sale Liquor License at 2217 Snelling Avenue <br />Finance Director Chris Miller advised that this action would issue the final Off- <br />Saleintoxicating liquor license, as per City Code, with a total often licenses. <br />Mr. Miller advised that all background investigations had been found to be in or- <br />der, and noted that the City Attorney would provide a final review prior to the li- <br />censebeing issued. <br />Councilmember Roe noted that the previous land use application approval for this <br />site was contingent upon approval of the liquor license. <br />Mayor Klausing opened and closed the Public Hearing at 6:53 p.m., with no one <br />appearing for or against. <br />Pust moved, Klausing seconded, approval of the Off-Sale Intoxicating Liquor Li- <br />cense for Snelling Liquors, located at 2217 Snelling Avenue, effective March 1, <br />2008 and expiring December 31, 2008. <br />Councilmember Pust opined that, while preliminary discussions were held on the <br />number of liquor licenses the City wished to issue it was unrelated to this request <br />and could be held in the future if and when another application was received. <br />Councilmember Pust further opined that this applicant had made good faith of-- <br />forts and done their due diligence, throughout the land use and liquor license ap- <br />plication and review period. <br />Councilmember Ihlan expressed concern in taking up this issue with tonight's <br />agenda running early, in case members of the public wished to speak to this. <br />Councilmember Ihlan opined that pervious public comment was heard during the <br />land use application as to whether this was an appropriate use in this area, and she <br />was basing her vote on whether this was a qualified applicant for a liquor license. <br />Councilmember Roe noted that the reason for the land use application was be- <br />cause of the "stand alone" nature of this facility, and that if it were located in the <br />adjacent multi-tenant facility, there would have been no need for a land use appli- <br />cation or approval process.
