Regular City Council Meeting <br />Monday, March 24, 2008 <br />Page 11 <br />stances weighed in on his decision for the land use application, as well as this liq- <br />uor license application. <br />Roll Call <br />Ayes: Pust; Ihlan; Roe; and Klausing. <br />Nays: None. <br />Finance Director Chris Miller clarified, for the City Council and public informa- <br />tion that all mailed and published hearing notices advised that the start time was <br />6:00 p.m. <br />a. Public Hearing for Lake Owasso Safe Boating Association's Request for <br />placement of 2008 Water Ski Course and Water Ski Jump <br />City of Roseville Police Captain Rick Mathwig advised that, since completion of <br />the Council Agenda packet, one additional revision had been made; adding the <br />City as an insured party to the Association's insurance policy, similar to Ramsey <br />County. Captain Mathwig advised that the certificate will be held by the City Of- <br />fice, and had been reviewed with the City Attorney's office. <br />Councilmember Ihlan questioned if there was a need to structure approval or <br />reach an agreement releasing the City from any liability. <br />Discussion included the City's actual liability (none); City Attorney opinion that <br />listing the City as an additional insured made no difference, as the City already <br />had immunities under State law provisions, and Statute 466 with tort cap limits; <br />and City Attorney Anderson stating, for the record, that he had no liability con- <br />cerns for issuing the permit, with or without listing the City as an additional in- <br />sured. <br />Applicant representative, Steve Youngquist, 491 S Owasso Blvd. <br />Mr. Youngquist, speaking on behalf of the Lake Owasso Safe $oating Associa- <br />tion, noted that there had been no past issues with safety, and advised that the as- <br />sociation was seeking City Council support for the course. <br />Councilmember Pust asked who the insured "USA Water Ski, Inc.," from Florida <br />was, indicating the named insured on the Certificate of Insurance. <br />Applicant representative, Steve Gallop, 435 Walnut Lane, Shoreview <br />Mr. Gallop advised that USA Water Ski was the parent organization for all water- <br />skiing in the U.S. and allowed individual clubs to purchase insurance coopera- <br />tively. <br />Councilmember Pust reviewed citizen comments heard last year, and sought re- <br />sponse from the club on those concerns, including placement of the jump and <br />course and the club's willingness to bring forth usage data from 2007 with this <br />
