The Operator shall have exclusive custody and control <br /> <br />of the ski area during the season which shall be defined' as <br /> <br />the period in each year from the 15th day, in November to the <br /> <br />15th day of April of the following year and shall have the <br /> <br />sole and exclusive discretion to refuse or remove customers, <br /> <br />or potential customers who, in the opinion of the Operator, are <br /> <br />or would create a problem in maintaining discipline and order. <br /> <br />or are so comporting themselves as to be a hazard either to <br /> <br />themselves or to other customers utilizing the facilities. <br /> <br />3. Franchise fee paid by the Operator to the Village <br /> <br />shall be one-half (1/2) of the annual net profit hereafter <br /> <br />defined of the operator with a minimum annual payment of <br /> <br />Twelve Hundred and No/lOO ($1,200.00) Dollars. This payment <br /> <br />shall be made on or before the 15th day of May following the <br /> <br />close of each skiing season, with the first annual payment <br /> <br />due the 15th day of May, 1968. <br />Gross income shall include the following items of <br /> <br />income of the operator: <br /> <br />a. Sale of tow tickets. <br /> <br />b. Income derived from ski lessons. <br /> <br />c. Sale of merchandise on the premises including <br /> <br />confections and food. <br /> <br />d. Income from pay telephones. <br /> <br />e. Income from the rental of ski equipment to <br /> <br />the public. <br /> <br />-2- <br />
