<br />FRANCHISE AGREEMENT <br />THIS CONTRACT, made and ente~ed into this 29th day of <br /> <br />December, 1967, by and between the Village of Roseville, a <br /> <br />Municipal corporation of the State of Minnesota, hereinafter <br /> <br />referred to as the "Village", and Villa Park Ski Corporation, <br /> <br />a corporation pursuant to the laws of the State of Minnesota, <br /> <br />hereinafter referred to as the "Operator", WITNESSETH, <br /> <br />WHEREAS, the Village owns a park site known as Villa <br /> <br />Park near the southeast corner of the intersection of County <br /> <br />Road B and Dale Street in said Village, and <br /> <br />WHEREAS, John Rysgaard, the president and principal <br /> <br />shareholder of the Operator is an experienced ski tow designer <br /> <br />and operator, and <br /> <br />WHEREAS, the Village is desirous of constructing a ski <br /> <br />tow facility in said park under a franchise agreement. <br /> <br />NOW, THEREFORE, IT IS HEREBY AGREED, AS FOLLOWS: <br /> <br />The Village does hereby grant a franchise to the <br /> <br />operator for the purpose of constructing and operating a <br /> <br />ski tow area between the date of this contract and the 30th <br /> <br />day of April, 1980. Said franchise is granted upon the <br /> <br />following terms and conditions. <br /> <br />'PERMS <br /> <br />1. The Operator shall forthwith commence construction <br /> <br />of the said ski area and include such buildings and tow lift <br /> <br />facilities as set forth in an attached plat marked "Exhibit <br /> <br />A" attached hereto and made a part hereof, provided that it <br /> <br />shall not be the obligation of the Operator to construct the <br /> <br />fence line as shown on said plat, unless specifically instructed <br />
