All fees and charges to the public established <br /> <br />by this agreement, and as established for subsequent years <br /> <br />of operation under this agreement, shall be exclusive of <br /> <br />fees, taxes, charges of any type or nature imposed by loc~ <br /> <br />J <br /> <br />state or federal governments, and which are required to be <br /> <br />paid or collected by the Operator, and the Operator reserves <br /> <br />the right to impose said fees, charges and taxes in addition <br /> <br />to the schedule of charges hereinabove provided for. If <br /> <br />any taxes, other than income taxes, are.'imposed upon the <br /> <br />Operator, based upon its claimed ownership of equipment, <br /> <br />or its right to do business, such charges and taxes shall <br /> <br />be included in the expenses of operation, as hereinabove <br /> <br />set forth, and deducted from the gross operating income <br /> <br />in determing gross profit. <br /> <br />10. In consideration of the Operator making a substantial <br /> <br />investment in time and equipment for the purpose of constructing <br /> <br />the said ski tow and facilities, the Village agrees not <br /> <br />to construct any other municipal mechanically operated <br /> <br />s~i tow within the Village of Roseville for the term of <br /> <br />this agreement without the prior w~itten approval of the <br /> <br />Operator, provided, that the Village reserves the right to <br /> <br />grant licenses and permits for such ski tow operations <br /> <br />upon private property and by private operators as the <br /> <br />Village, in its sole discrition, shall see fit. <br /> <br />-7- <br />
