<br />I <br />I <br /> <br />11. This contract shall expire April I, 1980, at <br /> <br />which time the Operator shall have no further interest <br /> <br />in the park or any further improvements. The following <br /> <br />items shall become property of the Village. <br /> <br />a. All buildirqs constructed on the premises. <br /> <br />b. All ski tows and equipment and motors used <br /> <br />to operate ski tows. <br /> <br />c. All rental equipment, such as skis, ski boots, <br /> <br />and other items used by the Operator to rent to the general <br /> <br />publ ic. <br /> <br />d. Any other item constructed by the Operator <br /> <br />and charged by the Operator as a capital expense. <br /> <br />The following~ems shall be the property of the <br /> <br />Operator. <br /> <br />a. Any equipment used in maintaining the slopes <br /> <br />such as tractors and attachments. <br /> <br />12. The Village shall have the right to terminate <br /> <br />this agreement and assume complete control and ownership <br /> <br />of the facilities of the Operator commencing on April I, <br /> <br />1974. <br /> <br />For the Village to exercise its right to assume <br /> <br />control, they shall pay to the Operator a percentage of <br /> <br />his total capital cost and those percentages shall be <br /> <br />as follows: <br /> <br />1974 - 6/12 of the costs invested <br />1975 - 5/12 of the costs invested <br />1976 - 4/12 of the costs invested <br />1977 - 3/12 of the costs invested <br />1978 - 2/12 of the costs invested <br />1979 - 1/12 of the costs invested <br /> -8- <br />
