Regular City Council Meeting <br />Monday, May 12, 2008 <br />Page 8 <br />City Manager Malinen advised that it was his intent to have it as a Deparhnent <br />Assistant, with the capacity of Firefighter, and concurred that the position descrip- <br />tion was not accurate or consistent with that intent. <br />Councilmember Pust questioned if there was any other pension considerations, <br />specifically to the Volunteer Relief Association, that needed to be considered. <br />City Manager Malinen advised that this would become afull-time position, and <br />would not be eligible for those benefits. <br />After further discussion, and proposed language revisions, it was Council consen- <br />sus that the title, first line of the job description and scope of responsibility be re- <br />vised for consistency and intent, and returned at a future meeting for Council re- <br />view and consideration. <br />c. Adopt a Resolution Revising Resolution 10540 relating to Fire Relief Associa- <br />tion By-Laws (Former Consent Item 7.b) <br />At the request of Mayor Klausing, City Manager Bill Malinen briefly reviewed <br />the request for corrections to the previously approved Fire Relief Association By- <br />Laws, as indicated. Mr. Malinen noted the revisions had previously been ap- <br />proved by the Relief Association, prior to City Council adoption of Resolution <br />No. 10570 in November of 2007. <br />Councilmember Ihlan opined that she didn't remember reviewing the specific is- <br />sue identified in Attachment B, Section 52B entitled, "Membership and Dues;" or <br />a review of the background information or a subsequent policy discussion. <br />Councilmember Pust further questioned whether the proposed language was in <br />violation of the State's Human Rights Act; and requested the City's legal counsel <br />to review and make recommendation prior to adoption. <br />City Attorney Scott Anderson suggested that his office provide a review and ad- <br />vice on this issue, given the specialized law on firefighters and relief associations. <br />The City Attorney was requested to review the issue and advise, and staff was re- <br />quested to return with background information and past City Council discussion <br />information, for City Council review and consideration. <br />d. Approve Northwestern College Public improvement Contract (former Con- <br />sent Agenda Item 7.i) <br />At the request of Mayor Klausing, City Manager Bill Malinen briefly reviewed <br />the request for Council approval of the Public Improvement Contract as pre- <br />sented. <br />
