Regular City Council Meeting <br />Monday, May 19, 2008 <br />Page 21 <br />Mr. Noble reviewed each specific section, with staff, Councilmembers. <br />Section 9.14 (Development Fees <br />Mr. Noble sought flexibility for payment of infrastructure costs (i.e., through spe- <br />cial assessment) rather than payment in full at the time of building permit applica- <br />tion. <br />Community Development Director Patrick Trudgeon agreed that staff was in the <br />process of discussing various payment options for infrastructure costs, and if so, <br />would require modification of this agreement or a separate agreement. Mr. <br />Trudgeon advised that the language needed to state clearly the stipulations, with <br />the applicant seeking their request for flexibility be a part of the record. <br />Section 9.15 Temnorarv Access <br />Mr. Noble sought to have clarification from the City's Engineering Department <br />the practical application and definition of an "all weather temporary emergency <br />access road," stipulating that a secondary passage, adequate to allow for emer- <br />gency vehicles access to the site at all times, be provided using the existing road <br />where adequate, rather than the additional cost for constructing an entire roadway; <br />and flexibility to consider future access possibilities. <br />Public Works Director Duane Schwartz addressed the request providing his con- <br />cerns and those of the Fire Marshal were addressed for providing a secondary ac- <br />cess; and if the next project came forward with a better secondary access, it would <br />be an acceptable alternative to staff, provided more than just the existing partial <br />access was available. <br />Mr. Noble rationalized the requested changes by the developer due to the haste in <br />preparation of the final PUD documents by staff. <br />Councilmember Pust suggested revised language to Section 9.15 as follows: <br />"Temporary Access: A temporary emergency vehicle access road shall be con- <br />structed (or maintained to an improved public roadway connecting to the <br />subject property] <br />. This roadway shall be <br />constructed at a minimum twenty foot (20') width and of an all-weather design <br />approved by the Fire Marshal." <br />The revised language was approved by consensus of the City Council, staff and <br />the developer. <br />City Attorney Squires concurred that the revised language seemed to be reasona- <br />bly sufficient. <br />
