Regular City Council Meeting <br />Monday, May 19, 2008 <br />Page 20 <br />$225,000 contingency, pending final approval of documents by the City Attorney; <br />amended to read: "and City Council approval of a funding mechanism by the June <br />9, 2008 regular City Council meeting. <br />Councilmember Ihlan advised that she would be voting in opposition to the pro- <br />ject tonight, due to the many uncertainties with funding; and strongly encouraged <br />that the project be delayed until 2009 to determine if it would be more financially <br />feasible at that time; noting that if costs are skyrocketing on this project, they <br />would also be skyrocketing on other projects and daily operations. <br />Councilmember Roe spoke in support of the motion; opining that many of the <br />City's operational costs are personnel-related. <br />Ayes: Pust; Roe; and Klausing. <br />Nays: Ihlan. <br />Motion carried. <br />Roll Call <br />Mr. Brokke thanked staff members for all their work on this project. <br />d. Consider Final Development Plan Planned Unit Development (PUD) Agree- <br />ment for Cent Ventures <br />City Planner Thomas Paschke summarized the request of the developer as per the <br />staff report fora 123-room hotel to be developed on the Xtra Lease trucking site <br />at 2700 Cleveland Avenue (PF07-021). <br />Mr. Paschke provided a bench handout, with revised language for various sections <br />highlighted (in blue) of the PUD Agreement for Sections 9.1, 9.2, 9.4 and 9.8, in <br />additional to overall renumbering of the document based on those revisions. Staff <br />recommended approval, through three motions as outlined in the staff report, and <br />as revised in the bench handout. <br />Discussion included the separation of land use issues versus any future requests <br />for developer subsidy; directional setback provisions and suggested revisions, <br />based on the building placement and setback minimums and maximums as out- <br />lined in the urban design guidelines for the Twin Lakes Redevelopment Area; <br />pathway provisions in rights-of--way south of the development; Twin Lakes Park- <br />way connections; and additional future rights-of--way. <br />Applicants Tom Noble Am West and John Livingston, Cent Ventures <br />Mr. Noble provided a bench handout entitled, "Clarifications to Planned Unit De- <br />velopment Agreement #1364 with Cent Ventures LLC," seeking to clarify, on be- <br />half of the applicants, Sections 9.14 (Development Fees), Section 9.14 (Tempo- <br />rary Access), and Section 9.18 (Final Right-of-way/Public Easements) of the De- <br />velopment Agreement. <br />
