ORDINANCE NO. 1370 <br />AN ORDINANCE AMENDING TITLE 10 OF THE CITY CODE, SPECIFICALLY SECTIONS <br />1002.02,1005.07,1012.02,1012.03,1012.04 AND 1012.05 AND PERTAINING TO <br />NON-CONFORMING STRUCTURES AND USES <br />THE CITY OF ROSEVILLE ORDAINS: <br />SECTION 1. The Roseville City Code, Title 10, Section 1002.02 (Definitions - <br />Non-Conforming Pre-Existing Structure or Uses) is hereby amended as follows: <br />1002.02: DEFINITIONS: <br />NON-CONFORMING PRE-EXISTING STRUCTURES OR USES: <br />Any lot, building, structure or use which does not comply with current <br />Code requirements, but which complied with existing regulations at the <br />time the building or structure was constructed or the use was established. <br />Such a building or structure or use may be continued including through <br />repair, replacement, restoration, maintenance, improvement, and <br />expansion (but only as specifically authorized in Section 1011.02 of <br />this Title). <br />NON-CONFORMING ILLEGAL STRUCTURE, USE, OR LOT: A <br />lot, building, structure, or use illegally established when it was initiated, <br />created, or constructed, which did not conform with the applicable <br />conditions or provisions of the City Code for the district in which the lot, <br />building, structure or use is located. <br />SECTION 2. The Roseville City Code, Title 10, Section 1005.07 (Mixed Use <br />Business District -Non-Conforming Uses) is hereby eliminated: <br />SECTION 3. The Roseville City Code, Title 10, Section 1012.02 (Non- <br />conforming Use -Existing Structures or Uses) is hereby amended as follows: <br />CHAPTER 1012, NON-CONFORMING USE: <br />1012.02: EXISTING STRUCTURES OR USES: <br />A. A pre-existing nonconforming use or structure may be continued including <br />through repair, replacement restoration maintenance or improvement A <br />pre-existing structure or use maY not be expanded unless• <br />A. Residential District (R-1/R-2) Exceptions: <br />1. An expansion of apre-existing residential principal or accessory <br />structure in an R-1 or R-2 zoning district, including shoreland and <br />wetland overlay district properties, which maintains the same <br />property line setbacks and structure separations provided there is <br />no further encroachment of any nonconforming structural <br />dimension or increase in the nonconformity or a change in use of <br />the land. <br />
