However, Mayor <br />Klausing suggested that the discussion be held on a broader realm in considera- <br />tion of the health, safety and welfare underpinnings, and rationale for whether the <br />ordinance should be amended for another 1-2 licenses. <br />Councilmember Pust opined that tonight's discussion was public; and expressed <br />her willingness to have that discussion at this time. Councilmember Pust opined <br />that, while not having the materials previously referenced by Councilmember Ih- <br />lan on other community comparisons and their regulation criteria, she recalled <br />that 10 was a high average based on population, and opined that since it took 23 <br />years to reach 10 licenses, she didn't find any particular reason to increase to 11 <br />or 12 licenses. Councilmember Pust opined that her perception is that the market <br />was making the rules, and that an applicant interested in obtaining a license <br />should buy one from an existing licensee. Councilmember Pust opined that in this <br />highly-regulated industry, it provided some social good, but also created a lot of <br />public harm, and its regulation was justified throughout the country. <br />Mayor Klausing expressed his personal interest in further discussions of this is- <br />sue. <br />No action taken. <br />13. Business Items -Presentations, Discussions <br />a. Ordinance Amending Section 103.06, Filling A Council Vacancy <br />City Councilmember Dan Roe reviewed proposed draft ordinance language to <br />change the City's special election provision to broaden its use to cover any type of <br />vacancy, rather than the current limitation to cases when a Councilmember as- <br />sumed anincompatible office. <br />Councilmembers referenced agenda packet materials and correspondence, as well <br />as public comment received to-date. <br />Discussion included what was being attempted for correction in the proposed or- <br />dinance language for election of Councilmembers by the electorate rather than <br />appointed by elected officials; timing for special elections and representing the <br />will of citizens; voter turnout based on timing of special elections; reasonable <br />campaign lengths; and consideration of alternate language as proposed in written <br />comment from Councilmember Ihlan included in the packet materials. <br />Councilmembers Pust and Willmus spoke in support of Councilmember Roe's <br />proposed language in general. <br />Roe moved, Pust seconded, enactment of Ordinance No. 1373 entitled, "An Ordi- <br />nance Amending Title 1, Section 103.06, Filling A Council Vacancy." <br />
