development area and subsequently was included in the environmental review contained in the <br />Twin Lakes Business Park Final AUAR Update. <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to DENY the <br />Citizen Petition for an EAW on the Applewood Pointe at Langton Lake development located at <br />3008-3010 Cleveland Ave. N. based on the following: <br />a. Minnesota Rules 4411.4600 (Exemptions), subpart 2 (Standard Exemptions) E <br />EXEMPTS projects for which environmental review has already been completed <br />from being required to conduct further environmental review. <br />b. On October 15, 2007, the City Council, pursuant to Minnesota Rules 4410.3600, <br />adopted the "Twin Lakes Business Park Final AUAR Update, an environmental <br />review document for the whole Twin Lakes development area. <br />c. 3008 and 3010 Cleveland Ave. N, the properties proposed to be developed, were <br />included as part of the environmental review contained in the Twin Lakes <br />Business Park Final AUAR Update. <br />d. Under EQB Rules, the Roseville City Council is not allowed to require an EAW <br />because the project is exempt. <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member Roe and upon vote being taken thereon, the following voted in favor: Pust, Roe, <br />Willmus, Klausing <br />and the following voted against: Ihlan. <br />WHEREUPON said resolution was declared duly passed and adopted. <br />2 <br />
