Regular City Council Meeting <br />Monday, August 25, 2008 <br />Page 11 <br />and prudent financial operations; funding for transportation needs (i.e., PMP); and <br />the City's ongoing efforts to bring their General Fund reserves up to target. <br />Roe moved, Willmus seconded, adoption of Resolution No. 10651 entitled, <br />"Resolution Accepting Proposal on the Competitive Negotiated Sale of <br />$2,550,000 General Obligation Equipment Certificates of Indebtedness, Series <br />2008A, Providing for their Issuance and Levying a Tax for the Payment Thereof;" <br />to finance the replacement of the Ice Arena refrigeration system, awarding the <br />winning bid to Stifel, Nicolaus & Company, Incorporated. <br />Councilmember Ihlan advised that she would be voting in opposition to the mo- <br />tion; opining that sale of the Equipment Bonds was not the appropriate way to fi- <br />nance the project by avoiding voter approval, rather than using a method seeking <br />their authorization; and further opining that tax impacts were significant to Rose- <br />villetaxpayers. <br />Roll Call <br />Ayes: Ihlan; Pust; Roe; Willmus; and Klausing. <br />Nays: Ihlan. <br />Motion carried. <br />c. Consider City Request to Perform an Abatement for City Code Violations at <br />2850 Fernwood Street <br />Permit Coordinator Don Munson reviewed the request for abatement as detailed <br />in the staff report dated August 25, 2008; advising that the current property owner <br />was unknown, and that the property was currently in foreclosure. Mr. Munson <br />provided updated photographs of the property and reviewed the condition of the <br />building and areas of concern where rodents were accessing the property. <br />Mr. Munson reviewed discussions, and advice of the City Attorney, regarding <br />protecting the City's expenditure, and ability to recoup them through assessment, <br />even though the property is in foreclosure. <br />Discussion included identification and status of current property owners; posting <br />of the property by the City that abatement was pending to ensure proper notifica- <br />tion; and actual maintenance to be undertaken in accordance with City Code. <br />Pust moved, Klausing seconded, directing staff to abate public nuisance violations <br />at 2850 Fernwood Street by hiring a general contractor to correct existing code <br />violations, as detailed in the Request for Council Action dated August 25, 2008, at <br />an estimated cost of approximately $3,000.00; and further directing that the prop- <br />erty owner be billed for all actual and administrative costs; and if those charges <br />remain unpaid, staff is to recover costs as specified in Minnesota Statute, Section <br />407.07B; with costs to be reported to the City Council following the abatement. <br />
