Regular City Council Meeting <br />Monday, August 25, 2008 <br />Page 20 <br />City Attorney Anderson reviewed State Statute 1599, and the applicant's rights <br />for a final decision by the municipality within 60-days, or 120-days if extended by <br />the City, the time period that would end, in this case, on September 6, 2008. Mr. <br />Anderson noted that this new legal issue brought to his attention by Councilmem- <br />ber Ihlan, required additional research by the City Attorney in relationship to how <br />the City Code read; and that the City was asking the applicant to waive the review <br />period in writing. <br />Mr. Trudgeon requested at least 60 days for review, rather than 30 to ensure due <br />diligence in reviewing the situation. <br />Mr. Hall sought clarification that the request was regarding whether the prelimi- <br />nary plat needed to be approved again, but not going through the building discus- <br />sion and process again. <br />City Attorney Anderson advised that Mr. Hall's interpretation would concur with <br />his interpretation; since the applicant had already proceeded through the General <br />Concept Plan, which had been approved, with the caveat being unless the prelimi- <br />nary plat resubmission was significantly different than the original plat. Mr. <br />Anderson clarified that the purpose of the requested waiver of the applicant by the <br />City was to review a procedural irregularity or jurisdictional issue. <br />Mr. Hall again volunteered the applicant's waiver of the 60-day review rule, if <br />that was the best option indicated. <br />City Attorney Anderson clarified, and Mr. Hall, representing United Properties, <br />confirmed that the applicant was waiving the 60-day rule from the extension pe- <br />riod expiring on September 6, 2008; acknowledging that the City Council was ta- <br />bling further action until a determination is made regarding status of the prelimi- <br />nary plat and final plat approval process timeline; and until staff brought forward <br />that information at a later date, anticipated to be 60-days from September 6, 2008. <br />City Attorney Anderson directed staff to follow-up tonight's action in writing <br />with the applicant. <br />Klausing moved, Pust seconded, TABLING for 60 days consideration of the Final <br />Plat (Applewood Pointe of Langton Lake) creating one (1) lot for a senior coop- <br />erative, an outlot for future development, and public road right-of--way dedication <br />for Langton Lake Drive, including all necessary public easements; consideration <br />of enactment of "An Ordinance Amending Title 10 of Roseville City Code, <br />Changing the Zoning Map Designation of Certain Real Property within the Twin <br />Lakes Redevelopment Area from Single-Family Residence District (R-1) to <br />Planned Unit Development (PUD) with an Underlying Zoning of General Resi- <br />dence District (R03);" and consideration of the Final Development Plan and <br />Planned Unit Development (PUD) Agreement between the City of Roseville and <br />United Properties (Developer) for Roseville Project File PF07-006. <br />
